AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, ESTABLISHING PROCEDURE FOR
RENEWAL OF CITY BUILDING PERMITS FOR CONSTRUC-
TION OF' FILLING STATIONS WITHIN SAID MUNICIPALITY;
PROVIDING FOR AN EFFECTIVE DATE, A SAVINGS CLAUSE
AND FOR OTHER PURPOSES.
PREAMBLE
This Ordinance is deemed to be an emergency measure enacted
for the immediate preservation of the public peace, property, health and
safety of the citizens of the CITY OF BOYNTON BEACH, FLORIDA, and
to allow for the orderly daily operation of the Municipal Building Depart-
ment and to avoid confusion and conflicts relative applications for-building
permits for filling stations which are otherwise governed by certain distance
requirements.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA;
SECTION 1: That section 106. 3 of Section 5-2, of the codified
ordinances of the CITY OF BOYNTON BEACH, FLORIDA, is hereby amendec
by adding after sub-paragraph (b) thereof, an additional sub-paragraph to be
designated sub-paragraph (c) to read:
(c). With regard to renewal ~of voided b~ldi~g~pe~if~i~ for
the construction of gasoline filling stations, the locations of which are
otherwise governed by certain distance requirements set forth in other
portions of the Ordinances of the City, no such permit shall be ~_~.enewed
if an application or applications have been previouSly filed with the Municipal
]Building Department for a permit to construct a filling station at a location
within':~!.~ prohibited distance of the site covered by the proposed renewal
application. The priority of all such filling station building permit
applications, renewal or otherwise, shall be governed by their respec~tive
dates of filing and the earliest application which otherwise meets the dis- -
tance requirements shall be entitled to issuance of a permit.
SECTION 2. Separability. Each of the provisions of this ordin-
ance are separable, including word, clause, phrase or sentence, and if any
provision hereof shall be declared invalid, the remaining portion shall not
be affected but shall remain in full force and effect.
SECTION 3. Repealing Provisions. Ail ordinances or parts of
or~inances in conflict herewith are hereby repealed.
SECTION 4. Effective Date. This ordinance is deemed to be
an emergency measure and shall take effect immediately upon passage.
