O63-11ORDINANCE NO. 63- 11 AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 23A OF THE CODIFIED ORDINANCES OF SAID CITY {OTHERWISE DESCRIBED AS ORDIN- ANCE NO. 59-6) ESTABLISHING RATES, FEES AND OTHER CHARGES FOR THE USE OF THE SERVICES AND F-ACILITIES OF THE MUNICIPAL SEWER DISPOSAL SYSTEM-AND FOR OTHER PURPOSES. Pre amble. This ordinance is deemed to be an emergencey measure enacted for the immediate protection of the health, safety and welfare of the citizens of the CITY OF BOYNTON BEACH, FLORIDA~ for the daily operation of the Municipal sewer system and the City Finance Department, in order to provide sufficient income to operate and maintain said .sewer system. It is further determined as a. fact~ based upon the report of the City's Consulting Engineers, RUSSELL & A'XON~ that the rate changes set forth in this ordinance are sub- stantially pro rata as to all classes of service. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SECTION 3:: That Section 23A - 3 of the codified ordinances of the CITY OF BOYNTON BEACH, FLORIDA (otherwise described as SECTION 1 of Ordinance 59-6) is hereby amended to read: "Section 1. The rates, fees and charges (herein sometimes called the "Sewer Service Charge") for the use of, and for the services and facilities furnished or to be furnished by, the sewage disposal system~ to be paid by the owner~ tenant, or occupant of each lot or parcel of land which may be connecte with or may use the sewage disposal system by or through any part of the sewe: system of the City, shall be based or computed upon the number and kind of plumbing fixtures connect~ with the sewer system or upon the quantity of the water supplied therein, as indicated in the following rate schedule: Residential Customers 5 fixtures or less next 7 fixtures and over 12 fixtures= $ 3.25 per month minimum 0. 35 each per month 0. 20 each per month Commercial Customers (excluding restaurants, laundries, hospitals, nursing homes and institutional type buildings) 2 Fixtures or less next 8 fixtures all over 10 fixtures $ 3.25 per month minimum 0.50 each per month 0.25 each per month Industrial and Manufacturing Customers, ~ncluding restaurants, laundries, hospitals, nursing homes and institutional type buildings) all 0 - 3, 000 gallons;~: next 2, 000 gallons next 20, 000 gallons next 10, 000 gallons over 35,000 gallons $ 5.00 per month 0.40 per thousand 0.30 per thousand 0.25 per thousand 0.20 per thousand In addition to the rates set forth herein, the City Council reserves the right to require pre-treatment, special rates or other measures necessar~ to cope with and protect the City against the introduction of unusual types of waste in the City sewer system. SECTION 2: Separability. Each of the provisions of this ordinance are separable, including word, clause, phrase, or sentence, and if any provision hereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. SECTION 3: Repealing Provisions: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: Effective Date: This ordinance is deemed to be an emergency measure and shall take effect immediately upon passage. First reading and adoption this l~-~day of ~r~_~ , A.
