AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING SECTION 3-19 OF THE
CODIFIED ORDINANCES OF SAID CITY, ESTABLISHING
DISTANCES BETWEEN LOCATION OF BEER AND WINE
ESTABLISHMENTS~ FURTHER PROVIDING AUTHORITY
TO CODIFY, REPEALING PROVISIONS, AN EFFECTIVE
DATE, AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH~ FLORIDA:
SECTION 1: That Section 3-19 of the codified ordinances
of the CITY OF BOYNTON BEACH, FLORIDA, is hereby amended to read:
"Sec. 3-1~. Beer and wine establishment locations.
No license shall be issued to sell beer or wine at
retail for consumption on or off the premises within
200 yards, (measured by straight air line measure-
men:) from the nearest point of the place of business
in which there is an existing license to sell beer, wine,
or liquor, for consumption on or off the premises and
the nearest point of the proposed place of business of
such applicant, provided, hoWever, that this provision
shall not apply to licenses issued or to be issued to
applicants for license to sell beer or wine in connection
with 'dmly licensed restaurants and sold in conjunction
with the serving of regular meals, as elsewhere provided
by ordinance, nor in connection with a bona fide and duly
licensed grocery store engaged in selling beer and wine
for consumption off premises.
SECTION 2: Separability. Each of the provisions of this
ordinance are separable including word, clause, phrase, or sentence, and if
any provision hereof shall be declared invalid, the remaining portion shall
not be affected, but shall remain in full force and effect.
SECTION 3: Repealing Provisions. Ail ordinances or parts of
ordinances in conflict herewith are hereby repealed.
SECTION 4: Authority to Codify. Specific authority is hereby
granted to codify and incorporate this ordinance in the City's existing code.
SECTION 5: Effective Date. This ordinance shall become
effective in the manner and at the time provided for in the Charier and
Ordinances of the CITY OF BOYNTON BEACH, FLORIDA.
