O62-25ORDINANCE NO. 62- 25 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 11 OF THE CODIFIED ORDINANCES OF SAID CI!~.Y REGULATING THE LOCATION OF GASOLINE AND OIL FILLING STATION ~. '. OR SERVICE STATIONS WITHIN SAID CITY; FURTHER PROVIDING AUTHORITY TO CODIFY, REPEALING PROVISIONS, AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: That Chapter 11 of the Code of Ordinances of the CITY OF BOYNTON BEACH, to re ad: FLORIDA, be and the same is hereby amended GHAPTER 11 FILLING STATIONS Sec° 11-1. Definitions. The following words and phrases when used in this chapter shall for the purpose of this chapter have the meanings respectively ascribed to them: (a) Gasoline and oil filling stations or service stations: Any business wherein bulk gasoline, oil and petroleum products are stored for sale to the general public ~ retail or wholesale sale. (b) Distances: In measuring distances between location or estab- lishment of gasoline and oil filling stations or service stations, the same shall be measured along a straight line connecting the nearest point of the main building located on the established location and the main building located on the proposed location as indicated on the plans and specifications +~elative thereto. (c) Gasoline pump: Includes any instrument through which gasoline or oil can be dispensed. Sec. 11-2. Permitted locations. (a) No gasoline and oil filling station or service station shall be erected or located within two hundred yards of any church, hospital, school or other such institution, where large numbers of persons congregate, or within two hundred yards of the location of another gasoline and oil filling station or service station. (b) It shall be unlawful for any person to locate or cause to be located any gasoline pump, oil pump, grease pump or compressed air station within ten feet of any public right-of-way line. The location of such gasoline pump, oil pump, grease pump or compressed air station shall be located in such a manner that the vehicle being serviced shall not encroach upon any public right-of-way. SECTION 2: Separability. Each of the provisions of this ordinance are separable including word, clause, phrase, or sentence, and if any provision hereof shall be declared invalid, the rem. aining portion shall not be affected, but shall remain in full force and effect. SECTION 3: Repealing Provisions. All ordinances or parts or ordinances in conflict herewith are hereby repe~led. SECTION R. Authority to Codify: Specific authority is hereby granted to codify and incorporate this ordinance in the City's existing code. SECTION 5: Effective Date. T. his ordinance shall become effective in the manner and at the time provided for in the Charter and Ordinances of the CITY OF BOYNTON BEACH, FLORIDA.
