AN ORDINANCE OF THE CITY OF BOYNTON BEACH;
FLORIDA,~ AMENDING SUBSECTION 1 OF SECTION 15
OF ORDINANCE NO. 62-9 OF SAID CITY PROVIDING
FOR APPOINTMENT OF TWO ALTERNATE MEMBERS
TO THE BOARD OF ADJUSTMENT: PROVIDING FOR
AUTHORITY TO CODIFY, AN EFFECTIVE DATE AND
FOR OTHER PURPOSES.'
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. That subsection 1 of Section 15 of Ordinance
No. 62-9 of lhe CITY OF BOYNTON BEACH, FLORIDA, is hereby
amended to read:
"1. A Board of Adjustment is hereby established which
shall consist of five ~5) members to be appointed by the
City Council. The terms of 2 of the members appointed to
the initial Board shall be for 2 years each and the terms of
the remaining 3 members shall be for 3 years each.
Thereafter all full terms of Board membership shall be
for 3 years each. The City Council may appoint 2 alternate
members to the Board of Adjustment to serve in the
temporary absence of regular board members. The terms
of the initial alternate members appointed shall expire on
February 8, 1963. Thereafter, the terms of any such
alternate members appointed shall be for one year' from
date of appointment. The Chairman of the Board of
Adjustment shall determine the necessity of calling any such
alternate member or .members to sit, the intent of this
provision being to insure that a full Board of 5 members be
available to consider all matters coming before the Board".
SECTION 2: Separability. Each of the provisions of this
ordinance are separable including word, clause, phrase, or sentence, and
if any provision hereof shall be declared invalid, the remaining portion shall
nol be affected, bul shall remain in full force and effect.
SECTION 3. Repealing Provisions. All ordinances or paris
of ordinances in cor, flict herewith are hereby repealed.
SECTION 4. Authority to Codify_~. Specific authority is hereby
granted to codify and incorporate this ordinance in the City's existing code.
SECTION 5. Effective Date_ This ordinance shall become
effective in the manner and at the time provided for by the Charier and
Ordinances of the CITY OF BOYNTON BEACH, FLORIDA.
