AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, EXTENDING THE TERRITORIAL LIMITS
OF SAID MUNICIPALITY BY THE ANNEXATION OF A
CERTAIN UNINCORPORATED TRACT OF LAND
CONTAINING LESS THAN TEN REGISTERED
VOTERS, LYING CONTIGUOUS THERETO AND
WITHIN THE SAME COUNTY; REDEFINING THE
MUNICIPAL BOUNDARIES~ REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH~ PROVIDING FOR AUTHORITY
TO CODIFY; AN EFFECTIVE DATE, AND FOR
OTHER PURPOSES.
WHEREAS, the owner of the property more particularly
described hereinafter has heretofore petitioned the City Council of the City
of Boynton Beach, Florida, requesting the annexation of subject property
lying adjacent and contiguous to the territorial limits of said municipality
and within the same County, to the municipal territorial limits of said City;
and
voters; and
WHEREAS, said tract of land contains less than ten reg:
WHEREAS, all requirements of the charier of the City of
Boynton Beach,. Florida, relative annexation of contiguous terrirotry have
been complied with; and
WHEREAS. the City Council of the City of Boynton Beach,
Florida, deems the annexation of subject tract to be beneficial to the muni-
cipality and to the inhabitants of said tract,
NOW, TI-IEREFORE, be it ordained by the City Council of the
City of Boynton Beach, Florida:
SECTION 1: That the City of Boynton Beach, Florida, hereby
annexes the following described tract of land to the territorial limits of the
City of Boynton Beach, Florida:
The East 500 feet of the West 750 feet of the Northeast
Quarter of the Northeast Quarter of Section 16, Township
45 South, Range 43 East, Palm Beach County, Florida,
subject to a right-of-way of the South 50 feet of the North
Half of the Norlheast Quarter as set out in Deed Book 947,
Page 367.
SECTION 2: That subject tract hereinabove described is hereby
zoned "ZONE R-I
' AA, as more Particularly defined under lhe existing
zoning code of the City of Boynton Beach, Florida.
SECTION 3: Thai the boundaries of the Cily of Boynlon Beach,
Florida, are hereby redefined so as to include the above described properlF
SECTION 4: Separability. Each of lhe provisions of this
ordinance are separable and if any section, subsection, clause, phrase
portion of this ordinance is for any reason held invalid by any court of com-
petent jurisdiction, the remaining POrtions shall not be affected but shall
remain in full force and effect.
SECTION 5:: Authority to Codify._ Specific authority is hereby
granted to codify and incorporate this ordinance in the City's existing code.
SECTION 6. Rep~ling Provisions. Ail ordinances or paris of
ordinances in conflict herewith are hereby repealed.
SECTION 7: Effective Date. This ordinance shall become
effective in the manner and at the ii.me provided by the charier and ordinanc~
of the City of Boynton Beach, Florida.
