86-BBBA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, VACATING AND ABANDONING A PORTION OF NORTHEAST 8 AVENUE WITHIN THE PUBLIC WORKS COMPLEX OF THE CITY OF BOYNTON BEACH, FLORIDA, LYING BETWEEN THE NORTHERLY EXTENDED EAST RIGHT-OF-WAY LINE OF NORTHEAST FIRST STREET AND THE SOUTHERLY EXTENSION OF THE EAST LINE OF LOT 140, ARDEN PARK, SAID PROPERTY BEING MORE PARTICULARLY DESCRIBED HEREIN; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A DISCLAIMER FOR SAID STREET; PROVIDING THAT THE ATTACHED DISCLAIMER BE RECORDED IN THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, Peter L. Cheney, as City Manager of the City of 3oynton Beach, Florida, has requested abandonment of the herein- after described public street; and WHEREAS, comments have been solicited from the appropriate City Departments; and WHEREAS, public hearings have been held before the City's ?lanning and Zoning Board and the City Council on the proposed abandonment; and ' WHEREAS, based on the foregoing information, said public street no longer serves any useful purpose. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Boynton Beach, Florida, that: -Section 1: The City of Boynton Beach, Florida, by and through its City Council, does hereby vacate and abandon for public street purposes certain real property located in the City of Boynton Beach, Florida, to wit: A parcel of land lying in Section 21, Township 45 South, Range 43 East, City of Boynton Beach, Palm Beach County, Florida, said land being more particu- larly described as that portion of the forty (40) foot right-of-way named Northeast 8 Avenue (Orange Street) lying between the northerly extended east right-of-way line of Northeast First Street (Pine Street) and the southerly extension of the East line of Lot 140, ARDEN PARK, as recorded in the Palm Beach County Official Records in Plat Book 2, Page 96. Section 2: The Mayor and City Clerk are hereby authorized and directed to execute and deliver the attached Disclaimer and cause the same to be filed in the Public Records of Palm Beach County, Florida. Section 3: upon passage. 1 PASSED 1986.
