O62-02ORDINANCE NO. 62-2 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, ESTABLISHING PARKING REGULATIONS FOR TRUCKS AND OTHER COMMERC~L TYPE VEHICLES WITHIN THE CITY LIMITS OF THE CITY OF BOYNTON BEACH, FLORIDA; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE:. AUTHORITY TO CODIFY; A PENALTY FOR VIOLATION THEREOF, AND FOR OTHER PURPOSES. PREAMBLE. WHEREAS, the indiscriminate parking of trucks and other large vehicles in residential areas and upon the public thoroughfares of the City of Boynton Beach, Florida, is deemed to be detrimental to the health, safety and welfare of the inhabitants of said City, as well as an impediment to the orderly growth of the community, in order to protect life and in sure public safely, such parking as hereinafter defined is hereby declared to be a traffic hazard and a nuisance. NOW THEREFORE, be it ordained by the City Council of the City of Boynton Beach, Florida: SECTION 1. It is hereby declared~L~ful for any individual, firm or corporation to park or cause to be parked any farm tractor, semi- truck, trailer,/~r other motor vehicle of greater than three-quarters (3/4) ton capacity on any publicly dedicated street, alley or thoroughfare (including the entire right-of-way thereof) of the City of Boynton Beach, Florida, for a longer period than fifteen (15) minutes, unless the actual loading or unloadin~ of such vehicle is involved or in progress. SECTION 2. It is hereby declared unlawful for any individual, firm or corporation to park, farm tractor, semi-trailer, cause to be parked, or allow to be parked any truck or other motor vehicle of greater than three-quarters (3/4) ton capacity for a period of longer than fifteen (15) minutes in any residential area of the City of Boynton Beach, Florida, as defined on the Master Zoning Map of said City adopted Dece~mber 29, 1961, and now on file in the office of the City Clerk of said City, unless the actual loading or unloading of such vehicle is involved and in progress. SECTION 3: Repealing Provisions. Ail ordinances or parts of ordinances in conflict herewith are hereby repealed, however, this ordinance shall not be construed as authorizing trucks to utilize any street or other public thoroughfare of the City of Boynton Beach, Florida, over which such vehicular traffic is now prohibited by ordinance or lawful order of the Police De partme SECTION 4. Separability. If any section, sub-section, clause, phrase or portion of this ordinance is for any reason held invalid or un- constitutional by any court of competenl jurisdiction, such pot%ion shall be deemed a separate,distinct and independent provision and such holding shall not affect the validity of the remaining provisions thereof. SECTION 5. - Authority lo Codify. Specific authority is hereby granted to codify this ordinance. SECTION 6: Penalty. Any individual, firm or corporation con- victed of violating this ordinance shall be penalized by fine not exceeding $500.:00, or imprisonment in the City jail for a period not exceeding 90 days, or both fine and imprisonment. Each time period in which any violat ion occurs or continues, shall be deemed a separate and distinct offense. SECTION 7: Effective Dale. This ordinance shall become effectiw in the manner and at the time provided for by the Charter and Ordinances of the City of Boynton Beach, Florida. First reading this ~- day of ~~t~ , A.' Dj 1962.
