O61-40ORDINANCE No. 61-40 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO. 59-8 OF SAID CITY PROVIDING FOR RULES OF PROCEDURE RELATIVE ADMINISTRATIVE HEARINGS HELD THEREUNDER: RE- PEALING ALL ORDINANCES IN CONFLICT HEREWITH; AUTHORITY TO CODIFY, AN' EFFECTIVE DATE AND FOR OTHER PURPOSES. PREAMBLE. This Ordinance is deemed to be an emergency measure enacted for the immediate preservation of the public peace, property, health and of the inhabitants of the CITY OF BOYNTON BEACH, FLORIDA, and for the daily operation of the City Building Department of said_ city. BE IT ©lgD~~ BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEAC FLORIDA: SECTION 1. Sub-section ~B') of sub-paragraph 3 o~ sub- Section (G) of Section 8 of Ordinance No. 59-8 of the CITY OF BOYNTON BEACH, FLORIDA, effective September 17, 1959, is hereby amended to read: "(B) The hearing shall be conducted according to established rules relating to the evidence and witnesses. Any relevant evidence shall be admitted if it is the sort evidence on which responsible persons are accustomed to rely in the conduct of civil actions. The rules of privilege shall be effective to the same extent that they are now, or here~ter may be reco~ized in civil actions, and irrelevant a~d~ unduly..~ ~ repetitious:~ evidence shall be excluded." SECTION 2. Separability, Ea~h~.~,the p?o~s~o.ns-':.~s~,~ ff any provision hereof shall be deolare invalid by any cour~ of compe~en~ jurisdiction, the remainin~ provisions shall no~ be affected bu~ shall remain in full force and effect. SECTION 2. RePealin~ Provisions. All ordinances or par~ of ordinanae~ in co~lic~ herewith are hereby repealed. SECTION 4. Authority ~o ~odffy. Specific authority is hereby ~ran~ed ~o codify ~his ordinance. SECTION 5. Effeciive Date. This ordinance is deemed to be an emergency ordinance and shall become effective immedialely upon passage.
