O61-33ORDINANCE NO. 61-33 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 17 OF THE CODE OF ORDINANCES OF SAID CITY BY ADDING AN ADDITIONAL SECTION THERETO, MAKING THE COMMISSION OF ANY ACTS WITHIN THE CORPORATE LIMITS OF SAID CITY WHICH ARE RECOGNIZED BY THE LAWS OF THE STATE OF FLORIDA AS MISDEMEANORS UNLAWFUL: REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH: PROVIDING AN EFFECTIVE DATE~' AUTHORITY TO CODIFY: FOR A SAVINGS CLAUSE AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SECTION h That Chapter 17 of the Code of Ordinances of the CITY OF BOYNTON BEACH, FLORIDA, be and the same is hereby amended by adding thereto, after Section 17-59, an additional section to be numbered Section 17-60, to read: "Sec. 17-60. State misdemeanors. It shall be unlawful for any person to commit, within the corporate limits of the City, any act which is or shall be recognized by the laws of the State of Florida as a mis- demeanor, and the commission of such act s is hereby forbidden and declared a violation of this section. Whosoever shall violate the provisions of this section, upon conviction there~of, shall be punished by the same penalty as is therefor provided by the laws of the State of Florida, but in no case shall such penalty exceed a fine of five hundred dollars or imprisonment for more than ninety days, or both fine and imprisonment in the discretion of the municipal judge. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: If aqy section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or uncon- stitutional by any court of competent jurisdiction, such portion shall be deeme. a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. SECTION 4: Specific authority is hereby granted to codify this ordinance. SECTION 5: Effective Date: This ordinance shall become effective at the time and in the manner provided for by the charter and ordinances of the CITY OF BOYNTON BEACH, FLORIDA.
