AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, DECLARING IT UNLAWFUL FOR ANY PERSON
TO DRIVE OR OPERATE A VEHICLE OF ANY KIND,
NATURE OR TYPE WHATSOEVER ANYWHERE WITHIN THE
SAID CITY WHILE INTOXICATED OR DRUGGED: PRE-
SCRIBING THE PENALTIES FOR VIOLATION THEREOF:
AN EFFECTIVE DATE, AND FOR OTHER PURPOSES.
IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH~ FLORIDA:
SECTION 1: It is unlawful and punishable as hereinafter pro-
vided for any person who is under the influence of intoxicating liquors, when
affected to the extent that his or her normal faculties are impaired, to drive
or operate or be in actual physical control of any vehicle of any kind, nature
or type whatsoever anywhere within the municipal limits of the City of
Boynton Beach, Florida.
SECTION 2: It is unlawful and punishable as hereinafter pro-
vided, for any person who is under the influence of any narcotic or other drug
to such an extent that his or her normal faculties are impaired, to operate,
drive or be in actual physical control of any vehicle of any kind, nature or type
whatsoever anywhere within the municipal limits of the City of Boynton Beach,.
Florida:
(a) The fact thai a narcotic or other drug has been pre-
scribed or administered by a physician or other person
lawfully authorized to prescribe or administer such
drugs shall not be a defense to a violation of this section.
SECTION 3: Every person who is convicted of a violation of
ordinance shall be punished by imprisonment for not more than 90 days,
or by a fine not exceeding $500. 00, or both such fine and imprisonment in the
discretion of the judge of the municipal court of the City of Boynton Beach,
Florida.

SECTION 4: Repealing Provisions. Ail ordinances or paris
of ordinances in conflict herewith are hereby repealed, with the exceplion of
Section 187. 0177 Florida Model Traffic Ordinance as previously adopted by
Section 29-1 of the Code of Ordinances of the City of Boynton Beach, Florida,
which section shall remain in full force and effect.
SECTION 5: Separability. Each of the provisions of this ordinan,
are separable including word, clause, phrase, sentence or section, and if
any provision hereof shall be declared invalid by a court of compelent juris-
diction, the remaining portion shall not be affecled.
SECTION 6: Effective Date. This ordinance shall become e~fe~
at the lime and in the manner provide d for by the charier and ordinances of
the City of Boy~n Beach, Florida.
