A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH~ FLORIDA, DECLARING
ACQUISTION OF CERTAIN WELL SITES IN FEE
SIMPLE AND CERTAIN EASEMENTS MORE PARTICULARLY
DESCRIBED HEREINAFTER FOR THE PURPOSE OF THE
CONSTRUCTION, OPERATION, INSTALLATION AND
MAINTENANCE OF RAW WATER WELLS, TOGETHER WITH
EASEMENTS FOR THE INSTALLATION OF UNDERGROUND
WATER MAINS/PIPES, SANITARY HAZARD RESTRICTED
AREAS EASEMENTS AND THE ACQUISITION OF A
WATER TREATMENT PLANT SITE IN FEE SIMPLE,
TO BE A PUBLIC NECESSITY; AUTHORIZING THE
EMPLOYMENT OF APPRAISERS AND AUTHORIZING
THE FILING OF EMINENT DOMAIN PROCEEDINGS.
WHEREAS, the Director of Public Utilities has
recommended the acquisition of a Water Plant site, and certain
well sites in fee ~imple together with certain easements for the
purpose of constructing, installing, operating and maintaining
a Water Treatment Plant, raw water wells, together with the
installation of water mains/pipes, sanitary hazard restricted area
easements and to be a public necessity; and
WHEREAS, the Water Plant Site, raw water well sitel
and the specific permenent easements which must be acquired are
more particularly described in Exhibit "A" attached hereto; and
WHEREAS, funds are available for the above
described acquistions; and
WHEREAS, this Council finds that the acquisition
of said plant sites, raw water ~ell sites, and permanent easements
for the purpose of the construction, installation, operation and
maintenance of raw water wells, together with easements for the
installation of underground water mains/pipes, sanitary hazard
restricted area easements, described in Exhibit "A" attached
hereto, are a public necessity and essential to the interest of
the City of Boynton Beach, Florida.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Boynton Beach, Florida, that:
1. This Council adopts and ratifies those matters
set forth in the foregoing recitals.
2. The City Attorney is authorized and directed to
employ real estate appraisers for the purposes of securing
appraisals of the value of the property described in Exhibit "A"
for the purpose of acquiring the aforementioned needed legal
interest in said properties.
3. The City Attorney is hereby authorized and directed
to take the necessary steps for Boynton Beach, Florida, to acquire
in its own name by donation, purchase or eminent domain proceeding
the interest heretofore mentinned in the property described in
Exhibit "A" and to have prepared in the name of Boynton Beach all
papers, pleadings and other instruments required for that purpose,
and to see that all eminent domain proceedings are prosecuted to
judgment.
4. The City Attorney is hereby authorized and directed
to take such further action as is reasonably required to fully
accomplish the pu=pose hereinabove directed.
BE IT FURTHER RESOLVED that the property described in
Exhibit "A" is to be used for the following public purpose:
Water Treatment Plant site, raw water wells, monitoring
well sites, radial protective easements surrounding
well sites and easements for underground water main/
pipes for the transmission and distribution of water.
