3 A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA,
4 TO APPROVE AND AUTHORIZE THE ASSESSMENT AND
5 RECORDING OF NUISANCE ABATEMENT LIENS AGAINST
6 PROPERTIES IN THE PUBLIC RECORDS OF PALM BEACH
7 COUNTY, FLORIDA, WITHIN 60 DAYS OF ADOPTION OF THE
8 RESOLUTION; AND PROVIDING AN EFFECTIVE DATE.

10 WHEREAS, a contract vendor was requested by Community Standards to mow the lots,
11 remove vegetation and board up structures on the properties, described in Exhibit "A"; and
12
13 WHEREAS, the owners of the parcel(s) of property hereinafter described were invoiced
14 by the Finance Department in an effort to recoup these costs with no response; and
15
16 WHEREAS, said nuisance was not abated as required; and,
17
18 WHEREAS, all of the property owners listed in the attached Exhibit"A"were sent letters
19 offering them an opportunity to remit within 30 days in order to avoid incurring a lien on their
20 property; and
21
22 WHEREAS, the City Manager or his authorized representative has made a report of
23 costs actually incurred by the City and abatement of said nuisance as to the property(s)
24 involved, which is described in Exhibit "A" attached to this Resolution; and
25
26 WHEREAS, upon passage of this Resolution, the property owners will be furnished with
27 a copy of this Resolution, and given one more opportunity to remit all costs associated with
28 the abatement in full within 30 days of the passage of the Resolution, before transmittal to the
29 County for recordation of Liens; and

31 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
32 BOYNTON BEACH, FLORIDA AS FOLLOWS:

34 Section 1: Each Whereas clause set forth above is true and correct and
35 incorporated herein by this reference.

37 Section 2: The amount of costs incurred by the City and the abatement of the
38 above-described nuisance as to the parcels of land, owned and indicated to wit:

40 SEE ATTACHED EXHIBIT "A"

42 Subject amount is hereby assessed as liens against said parcels of land as
43 indicated, plus an additional administrative charge of$30.00 for each Lien. Liens
44 shall be of equal dignity with the taxes there from for the year 2024, and shall

45 be enforced and collected in like manner pursuant to applicable provisions of
46 law. In the event collection proceedings are necessary, the property owner shall
47 pay all costs of the proceedings, including reasonable attorney's fees.

49 Section 3. The City Clerk is authorized to record this Resolution in the public
50 records of Palm Beach County, Florida.

52 Section 4. This Resolution shall become effective immediately upon passage.
