85-SSSA RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, VACATING
AND ABANDONING CERTAIN PUBLIC UTILITY
EASEMENTS LOCATED IN BLOCK 54-A, OF THE
PLAT OF LAKE BOYNTON ESTATES, PLAT NO.
4-A, SAID PROPERTY BEING MORE PARTICULARLY
DESCRIBED HEREIN; AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A DISCLAIMER FOR
SAID ABANDONMENT; PROVIDING THAT THE ATTACHED
DISCLAIMER BE REOCRDED iN THE PUBLIC RECORDS
OF PALM BEACH COUNTY, FLORIDA; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, Town and Country Squire of North Miami, Inc.,
applied with the City of Boynton Beach, Florida, on or about
June 8, 1978, for the abandonment of a public utility easement;
and
WHEREAS, at its July 11, 1978, meeting, the Planning
and Zoning Board of the City of Boynton Beach unanimously approved
said abandonment subject to the relocation of the applicable
public utilities; and
WHEREAS, at its July 18, 1978, meeting, the City Council
of the City of Boynton Beach unanimously approved the subject
abandonment; and
WHEREAS, it appears from the records of the City that
no Resolution approving the abandonment and no Disclaimer had
ever been recorded in the public records of Palm Beach County,
Florida; and
WHEREAS, the City Council of the City of Boynton Beach,
Florida, now desire to correct this oversight by adopting this
Resolution abandoning the hereinafter described property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA:
Section i: The City of Boynton Beach, Florida, by and
through its City Council, does hereby vacate and abandon for
public utility easement purposes certain real property located
in the City of Boynton Beach, Florida~ to-wit:
The public utility easement being the
north 2.5 feet of Lots 21,22,23,24 and
25, Block 54-A, less the west 6 feet
of the north 2.5 feet of said Lot 21,
together with that public utility ease-
ment being the south 2.5 feet of Lots 2,
3,4,5, and 6, Block 54-A, less the west
6 feet of the south 2.5 feet of said
Lot 6, all as shown in the plat of Lake
Boynton Estates, Plat 4-A, as recorded
in Plat Book 14, Page 69, of the Public
Records of Palm Beach County, Florida.
Section 2: The Mayor and City Clerk are hereby
authorized and directed to execute and deliver the attached
Disclaimer and cause the same to be filed in the Public Records
of Palm Beach County, Florida.
Section 3: This Resolution shall take effect
immediately upon passage.

DISCLAIMER
KNOWN ALL MEN BY THESE PRESENTS that the City of Boynton
Beach, Florida, a municipal corporation under the laws of the State
of Florida, does hereby abandon and disclaim for public utility
easement purposes the following described property, situated and
located in Palm Beach County, Florida, to-wit:
The public utility easement being the
north 2.5 feet of Lots 21,22,23,24 and
25, Block 54-A, less the west 6 feet
of the north 2.5 feet of said Lot 21,
together with that public utility ease-
ment being the south 2.5 feet of Lots 2,
