R24-077 1 RESOLUTION NO. R24-077 2 3 4 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF 5 BOYNTON BEACH, FLORIDA, AUTHORIZING THE TRANSFER OF 6 CITY FUNDS IN FISCAL YEAR 2023/2024 TO PROVIDE 7 APPROPRIATIONS FROM THE STATE LAW ENFORCEMENT 8 FORFEITURE RECEIPTS FOR DONATION; PROVIDING AN EFFECTIVE 9 DATE; AND FOR OTHER PURPOSES. 10 11 12 WHEREAS, pursuant to the Florida Contraband Forfeiture Act, any local law 13 enforcement agency that acquires at least $15,000 within a fiscal year must expend or 14 donate no less than 25 percent (25%) of such proceeds. These funds may be expended 15 upon request by the Chief of Police to the City Commission; and 16 WHEREAS, such funds may be used only for school resource officers, crime 17 prevention, safe neighborhoods, drug abuse education, drug prevention programs, or 18 other law enforcement purposes as the municipality's governing body deems 19 appropriate; and 20 WHEREAS, the expenditure of $15,000 to the Boynton Beach Police Athletic 21 League, Inc., a not-for-profit corporation, is in compliance with section 932.7055(5)(c)3, 22 Florida Statutes; and 23 WHEREAS, the Chief of Police certifies that the State Forfeiture funds requested 24 comply with the permissible use reporting categories identified as (2) crime prevention; 25 and 26 WHEREAS, the City Commission of the City of Boynton Beach, Florida, deems it to be in 27 the best interests of the citizens and residents of the City of Boynton to approve the $15,000 28 donation to the Boynton Beach Police Athletic League, Inc., a not-for-profit corporation. 29 30 NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 31 BEACH, FLORIDA, THAT: 32 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 33 being true and correct and are hereby made a specific part of this Resolution upon adoption 34 hereof. 35 SECTION 2. The City Commission hereby approves the expenditure of $15,000 to 36 the Boynton Beach Police Athletic League, Inc., a not-for-profit corporation, in 37 compliance with section 932.7055(5)(c)3, Florida Statutes. 38 SECTION 3.
