A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, CONSENTING
TO THE TRANSFER OF A CABLE TELEVISION
FRANCHISE FROM UTA CABLE CORPORATION TO
ACCESS CABLE OF WEST BOYNTON, INC.;
PROVIDING AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
WHEREAS, on the 4th day of May, 1982, the City Council
of the City of Boynton Beach, Florida, by Ordinance No. 82-11,
granted a non-exclusive license to UTA Cable Corporation to
operate a community antenna television system in the Boynton
Lakes area of the City of Boynton Beach, Florida; and
WHEREAS, on the 17th day of July, 1984, the City Council

exclesive license ~o Access.Cable of West Boynton, i~Inc.~.';; to' operate a

WHEREAS, on the 5th day of February, 1985,
by Ordinance No. 85-1~, Access Cable of West Boynton, Inc.,
was granted permission to operate its community antenna televisio~
system throughout the City limits of the City of Boynton Beach,
Florida; and
WHEREAS, UTA Cable Corporaticn and Access Cable of West
Boynton, Inc., have entered into an agreement whereby UTA Cable
Corporation will sell, transfer or assign all of its right,
title and interests in providing cable television service as set
forth in Ordinance No. 82-11; and
WHEREAS, pursuant to Section 7-26(d) of the Code of
Ordinances, City of Boynton Beach, no such sale, transfer or
assignment shall be made without the prior consent of the City
Council expressed by Resolution; and
WHEREAS, UTA Cable Corporation and Access Cable of
West Boynton, Inc., both hereby request consent of the City
Council for the sale, transfer and/or assignment of said franchise
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: The City Council hereby consents to the
sale, transfer and/or assignment of the non-exclusive license
from UTA Cable Corporation to Access Cable of West Boynton, Inc.,
as originally set forth in Ordinance No. 82-11 of the City of
Boynton Beach, Florida. By accepting this sale, transfer and/or
assignment, Access Cable of West Boynton, Inc., hereby agrees to
comply with the terms and provisions of said non-exclusive license
and further to comply with the provisions of Chapter 7 of the
Code of Ordinances, City of Boynton Beach, Florida, which provisio
are hereby adopted by reference and made a part hereof as if set
forth herein.
