A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH, FLORIDA, VACATING A~) ABANDONING
A SPECIAL PURPOSE EASEM~Cr CONCERNING THE PROPERTY
HEREINAFTER DESCRIBED; AUTHORIZING THE MAYOR AND
CITY CI.ERK TO EXECUTE A DISCLAIMER FOR SAID
SPECIAL PURPOSE EASM~Tr; PROVIDING AND EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
WHEREAS, Alfred ~imrulli Jrt, owner of the property described
below has filed an application and has requested the abandonment of the
hereinafter described special purpose easement located in the City of Boynton
Beach, Florida, and
WHEREAS, conments have been solicited from the appropriate City
Departments, and
WHEREAS, public hearings have been held before the City's
Planning and Zoning Board and City Council on the proposed abandonment, and
WHEREAS, based on the foregoing information that said special
purpose easement no longer serves any useful purpose.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The City of Boynton Beach, by and through its
City Council, does hereby vacate a~nd abandon for special purpose easement
purposes a piece of real property located in the City of Boynton Beach,
Florida, tow it:
An existing 5' public utility easement being across
and centered on the corxaon rear lot lines of lots
1 thru 10 and 15 thru 24 inclusive of Block 3, Lake
Boynton Estates, Plat 1, according to the Plat thereof
as recorded in Plat Book 13, Public Records of Palm
Beach County, Florida.
Section 2:
This abandonment is subject to the satisfaction by
Applicant of the requirements of Grouo W Cable, Inc., Boynton Beach City
Utilities, Florida Power and Light, and Southern Bell, at the Applicant'.s
Section 3: The ~iayor and City Clerk are hereby authorized and
directed to execune and deliver the attached Disclaimer and cause the same to
be filed in the Public Records of Palm Beach County, Florida, upon wzitten
verification of satisfaction, of the requirements in Section 2.
Section 4: This Resolution shall take effect immediately upon
passage.

KNOW ALI, MEN BY THESE PRESENTS that the City of Boynton Beach,
Florida, a municipal corporation under the laws of the State of Florida, does
hereby abandon and disclaim for special .easement purposes the following
described property, situate and located in Palm Beach County, Florida, to-wit:
An existing 5' public utility easement being across and
centered on the common rear lot lines of lots 1 thru 10
and 15 thru 24 inclusive of Block 3, Lake Boynton Estates,
Plat 1, according to tile Plat thereof as recorded in Plat
Book 13, Public Records of Palm Beach County, Florida.
