O61-25 ORDINANCE No. 61 -.25 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, LEVYING SPECIAL ASSESSMENTS AGAINST PROPERTY BENEFITED BY A CERTAIN ALLEY IMPi~OVE- MENT PROJECT: RECITING BY WHAT METHOD SAID SPECIAL ASSESSMENT IS MADE, AND THE TiME WHEN SAME- SHALL BECOME PAYABLE: PROVIDING FOR METHOD OF COLLECTION THEREOF; AND FOR OTHER PURPOSES. WHEREAS, pursuant to the provisions of Section 160 of the Charter of the CITY OF BOYNTON BEACH, FLORIDA, the City has here- tofore caused a certain public alley to be constructed over the property more particularly described as follows: That certain Ten (10) foot alley lying between Northeast 3rd Street and Railroad Avenue, and abutting lots 1 through 6 inclusive, and lots 14 and 15, of ARDEN PARK, a subdivision of the City of Boynton Beach, Florida; and WHEREAS, the City Clerk has heretofore compiled an assess- ment roll showing the lots and land assessed to pay the cost thereof in connection with subject improvement and the amount of assessment as to each such lot, which said roll has been heretofore approved by the City Council; and WHEREAS, proper legal notice of the approval or said roll has been given and a public hearing held at which time no objections were made, or if objections were made, same were deemed insufficient by the City Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: 1. Thai the following special assessment roll is hereby ratified, approved and confirmed and the amounts indicated after each lot described therein is hereby levied against same as a special improvement assessment and same shall constitute a lien as of the effective date of this ordinance. TOTAL FRONT FOOTAGE TOTAL ASSESSMENT Each of the lots along subject improvement having been assessed on a front footage basis charging each parcel its proportionate share as divided into the total improve- ment cost. 2. Each property owner shall have the privilege of prepaying the entire assessment as to his proper~y within ninety (90) days from the attachment of said improvement lien without interest. If any owner fails to pay said lien within said ninety (90) day period, it shall be paid in three equal installmenis, payable as other ad valorem taxes are paid, with interest at the rate of 8% per annum from the date of attachment of said lien on the unpaid balance thereof. 3. Separability. If any part of this ordinance shall be deemed unlawful by a court of competent jurisdiction, such portion shall be deemed as a separate and distinct part hereof and such ruling shall not affect the validity of the remainder hereof. - 2- 4, Effective Date: This ordinance shall take effect at the time and in the manner provided by the charter and ordinances of the CITY OF BOYNTON BEACH, FLORIDA.
