O61-13 ORDINANCE NO. 61-13 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SEC. 12-2 OF THE CODE OF ORDINANCES, CITY OF BOYNTON BEACH, FLORIDA, RELATING TO FIRE PREVENTION AND PROHIBITING BULK STORAGE OF II~-FLAMABLE LIQUIDS WITHIN CERTAIN SPECIFIED LI1VIITS WITHIN THE MUNICIPALITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: PREAMBLE This Ordinance is deemed to be an emergency measure enacted for lhe immediate preservation of lhe public peace, property, health and safety, and for the daily operation of the municipal building and fire departments of the City of Boynton Beach, Florida, for the purpose of protecting the inhabitants of the said municipality from the inherenl dangers connected with lhe bulk storage of inflamable liquids within the territorial limits of said municipality~ SECTION 1. That Section 12-2 of the Code of Ordinances, City of Boynton Beach, Florida, being otherwise described as Section 3 of Ordinance No. 242 of said City, is hereby amended to read: "Sec. 12-2. SAME - AMENDMENT. The limits of Section 904 of said code in which bulk storage of inflamable liquids in outside aboveground tanks is prohibited, are hereby established as follows: Bounded on the East by the Florida Inland Navigation District Canal; on the North by the Boynton Canal; on the West by Seaboard Air Line Railroad~ and on the South by Woolbright Road (So~tt~ 15ih Avenue). Such bulk storage is also prohibited within (250) Two Hundred Fifty Feet of U. S. Highway No. 1. and within (-500) Five Hundred Feet of any church, school, theater, or other public gathering place, or similar type bulk storage tank installation located on any non-contiguous parcel. Any building permit issued for the construction of bulk storage tanks contemplated hereinabove, shall be subject to the imposition of any reasonable safety requirements deemed necessary by the City Council dictated by the physical location of the proposed site of such tanks. SECTION 2. SEPARABILITY: Each of the provisions of this Ordinance are separable, including word, clause, phrase or sentence, and if any provision hereof shall be declared invalid by a court of competent jurisdiction, the remaining portions shall not be affected but shall remain in full force and effect. SECTION 3. REPEALING PROVISIONS: Ail Ordinances or parts of Ordinances in conflict herewith are hereby repealed.. SECTION 4] EFFECTIVE DATE: This Ordinance is deemed to be an emergency Ordinance~ and shall take effect immediately upon passage. DATED this 14th day of June, A. D. 1961.
