O60-10ORDINANCE No. 60-10 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, PROVIDING FOR THE LEVYING OF CERTAIN SPECIAL ASSES~NTS AGAINST PROPERTY LOCATED WITHIN THE NUNICIPAL LI~ITS OF SAID CITY FOR ST~ET INPROVE~NTS; ~CITING BY WHAT ~ETHOD SAID SPECIAL ASSESSNENT IS ~DE AND THE TINE WHEN SANE SHALL BECONE PAYAB~ AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CI~f OF BOYNTON BEACHw FLORIDA, AS FOLLOWS: SECTION 1.That pursuant to the Charter of the City of Boynton Beach, Florida, the City Council of said City did at its regular meeting held on April 18, 1960, examine the report and assessment roll prepared by the Superintendent of Public Works covering certain improvements to portions of Northwest 8th Court, Northwest 10th Avenue, Northwest 8th Street and Northwest 6th Avenue, all located within the municipal limits of the CITY OF BOYNTON BEACH, FLORIDA, and found same to be in proper order and prepared in accordsmce with the requirements of the City Charter of said City, and did approve same, ~ and ~REAS, a hearing was held by the City Council on Nay 4, 1960, at the Boynton Beach City Hall, for the purpose~ of hearing complaints or objections to said assessment roll from property owners abutting subject above described improvements after notice of said meetin~ was duly published in accordance witl law, and WHEREAS, no objections were made to said assessment roll at said hearing, or if objections were made, same were deemed insufficient by the City Council; NOW, ~REPORE, the City CounCil of the CITY OF BOYNTON BEACH, FLORIDA, having fully complied with the requirement of its Charter and other applicable law, hereby levies the assess- merit shown on the aforesaid assessment roll, against the propertie therein described, covering the street improvements within said City and said assessment is hereby declared to be a lien against subject respective properties from the effective date of this Ordinance, each abuttin~ property owner along the above improvemen having been assessed on a front footage basis, charging said owner his proportionate share as divided by the total improvement cost. The property owners described in smbject assessment roll shall have the privilege of paying the entire assessment at any time within ~ days from the date of attachment of said improve- ment lien, or in the alternative, said lien shall be paid in three (3) consecutive equal annual payments, together with interest on the unpaid ba~nce at the rate of eiaht (8) percent per annu~, payable as other ad valorem taxes are paid. SECTION 2: ~.Separability: Each of the provisions of this ordinance are separable including, word, clause, phrase or sentence, and if any provision hereof shall be declared invalid, the remaining portion shall not be effected, but shall remain in ful.1 force amd effect. SECTION 3: Repealinq Provisions: All ordinances or parts of ordinances in conflict herewith are hereby repealed. First reading this ~th day of Nay, A. D. 1960.
