O59-11ORD!NANCE~59-11 AN ORDIhTANCE REQU/RI~JG THE RE-REGISTRATION OF VOTERS OF THE CITY OF BOYNTON BEACH, BE- TWEET THE 16TH DAY OF MARCH 1959, AND FIVE (~) DAYS BEFORE ANY PRIMARY OR GEneRAL, ELEC- TION OF THE YEAR 1959; PROHIBITING'P~SONS FROM VOTING WHO HAVE NOT SO RE-REGIST~ED; PROVIDING FOR RE-REGISTRATION OF P~qSONS WHO ~MERE UNABLE TO COMPLY BECAUSE OF CIRCUMST~k~CES BEYOND THEIR CONTROL - -REPEALING ALL ORDINANCES IN COL~LICT HEREWITH. WHEREAS, the City Council of the City of Boynton Beach, Florida, did on the 19th day of January 1959, ascertain that the Registration Book of the City of Boynton Beach had not been purged in the past; and WHA~EAS, the Council was informed that the Registration Book contained names of deceased registrants, registrants no longer residing in the City of Boynton Beach, improper addresses of registrants, registrants voting under name of previous mar- riages, duplicate registration of same person, registrants of freeholders whose status had changed; and WHEREAS, Chapter 24398, Section 135, Special Acts of 1947, provides that the City Council may provide for a re-registra- tion of the voters at the first meeting in July 1948~ and there- after at the first meeting in July every five years; and ~?m~EREAS, through neglect, inadvertence, or otherwise a re- registration of the voters was not made in July 1948; or July 1953, or July 1958, pursuant to the Charter; and WHEREAS, the conditions of the Registration Book as pre- sently existing are inadeq~uat%improper, and do mot comply with the Charter of the City, and the Council deems it imperative that the Registration Book be purged of all discrepencies, errors, and deficiencies, and declares that the matter is im- mergent; and WHEREAS, the voters of the City. of Boynton Beach have been duly notified of these matters and the need for re-registration; and WHF~EAS, the Council has set the 16th day of March 1959 as the commencement date for re-registration of voters; NOW, THEZEFORE, BE IT AND IT IS HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDa, AS FOLLOWS: SECTION 1: SECTION 2: SECTION 3: All persons who desire to vote in any election of the City of Boynton Beach, and were regis- tered prior to the 16th day of March 1959, must re-register in order to vote in a~ elec- tion of the City of Boynton Beach. All persons who have not re-registered with the City Clerk or her duly qualified deputy on or after the 16th day of March 1959 shall do so within the time limits stated below: (a) In the event a primary election is held, in order to be qualified to vote in said primary election, each voter must have re-registered between the 16th day of March 1959 and at least five (5) days before said primary elec- tion date, or by the llth day of Novem- ber 1959. (b) In the event no primary election is held; in order to be qualified to vote each voter must have re-registered be- tween the 16th day of March 1959, and at least five (5) days before said election date, or by the 25th day of November 1959. (c) In the event a primary election is held, and in the event voters have not re-registered before said primary elec- tion, re-registration will be permitted from the day after the primary election, until five (5) days before the General Election date, or on or between the 18th day and 25th day of November 1959. (d) In any event the registration books shall always be closed at least five (5) days before any General Election, and shall not be re-opened for further registration until the day after said General Election, at which time the registration books shall be. re-opened for registration. That all.persons who have not re-registered pursuant to (a), (b), (c) and (d) of SECTION 2 of this ordin- ance shall not be permitted to vote, unless said per- son shall produce a sworn statement, that he or she was unable to re-register because of circumstances beyond his or her control, stating the particular circumstances; the city clerk is hereby authorized to decide the su_eficiency of the allegation in the sworn statement and directed to resolve al! doubts in favor of registrants.
