O59-05 0RDINA~,~CE # 59-5 AN ORDINANCE DEFINING ?ETIT LARCENY - PRESCRIBING PENAL- TIES FOR VI0!~TiONS AND METHOD OF CHARGING DEFENDANT, R~EALING ALL ORDINANCES OR PARTS OF ORDIN~CES IN FLICT H~ITH · BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOO, TOM BEACH, FLORIDA, AS FOLLOWS: SECTION 1: Short Title. This ordinance shall be ~nowu and may be cited as the ~etit Larceny Ordinance of the City of Boynton Beach. SECTION 2: Any person who, with intent to deprive or defraud the true owner of his property or of the use and benefit thereof, or to appropriate the same to the use of the taker, or of any other person takes from the possession of the true owner, or of any other person; any money, personal property, goods and chattels, or articles of value of any kind, of the value of less than $100.00 shall be deemed guilty of petit larceny and upon victiou shall be punished by imprisonment in the City jail not exceeding three (3) months or by fine not ex- ceeding $300.00. SECTION 3: It shall be sufficient, for any affidavit or warrant re- turned, filed or issued under this ordinance to charge generally that the defendant at the time and place in the city, did steal the personal property or article of value out of which the prosecution arose, describing the same in general terms and alleging generally the ownership and value thereof.
