AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, ESTABLISHING THE JURISDICTION OF THE
CITY OF BOYNTON BEACH OVER JUVENILE OFFENDERS
OF TRAFFIC AND MOTOR VEHICLE LAWS; PROVIDING
PENALTY FOR VIOLATION HEREOF; PROVIDING FOR
SEPARATE COURT SESSIONS TO HEAR JUVENILE
OFFENDERS; PROVIDING TRANSFER OF SUCH OFFENDERS
TO JUVENILE COUR~T; REQUIRING THE CITY CLERK TO
FILE A COPY OF THIS OR'DINANCE WITH THE CLERK OF
THE JUVENILE COURT; AND FOR ALL PURPOSES
REASONABLY INCIDENTAL; AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH.
WHEREAS, by Chapter 57-577 of the laws of the State of
Florida enacted by 1957 session of the State Legislature, municipalities in
any county having an official population of over 113,000 people and less than
114, 750 people were given the right by ordinances to assume jurisdiction over
the apprehension, trial, hearing and dispositions of offenses cornmitted in
violation of ordinance or state laws relating to the regulation of traffic and
the operation of motor vehicles when such offenses are committed by persons
under seventeen years of age; and
WHEREAS, Palm Beach County had a population over 113,000
people and less than 114, 750 people according to the previous census;
NOW, THEREFORE, BE IT, AND IT IS HEREBY ORDAINED
BY THE CITY COMMISSION OF THE CITY OF BOYNT.ON BEACH, FLORIDA;
SECTION 1: Jurisdiction Over Juvenile Traffic Offenses.
(a) That the City of Boynton Beach, Florida, does hereby
assume jurisdiction over the apprehension, trial, hearing and disposition of
offenses committed in violation of its City ordinances or the state law relating
to the regulation of traffic and operation of motor vehicles when such offenses
are committed by persons under seventeen years of age.
(b) The Judge of the municipal court of the City of Boynton
Beach, Florida, is hereby empowered to impose upon such juvenile offenders
violating city ordinances or applicable state statutes reasonable fines, cost of
court, probation, and the suspension of any drivers license issued to any such
offender that the court may legally impose under the Charter and ordinances
of the City of Boynton Beach, providing, however, that no sentence of con-
finement or imprisonment may be imposed by the judge of the said Municipal
Court upon said juvenile offender.

(c) The Municipal Judge shall designate the time and place
of trial of such juvenile offenders except that such juvenile offenders shall be
heard in separate sessions of Municipal Court apart from all other type of
offenders.
(d) If, in the discretion of the Municipal Judge, it is
necessary or desirable for any such offender to be detained or confined for
any period of time in lieu of other type penalty or punishment, cases shall be
transferred to the jurisdiction of the Juvenile Court in and for Palm Beach
County, Florida. which court may thereafter hear and dispose of the same
ab initio and ~uch offenders shall be delivered to the proper official of said
Juvenile Court.
(e) That in imposing sentence on any juvenile offender the
Municipal Judge may suspend the drivers license of any such offender for such
time and under such conditions as he may feel reasonablr, and may likewise
require any such offender to attend sessimns of any school conducted for the
instruction of motor vehicle drivers in Palm Beach County.
SECTION 2. Thai upon adoption of this ordinance, the City
Clerk is hereby directed and instructed to promptly file a true, correct and
certified copy of this ordinance with the Clerk of the Juvenile Court in and
for Palm Beach County~ Florida.
SECTION 3. Ail ordinances or paris of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 4. If any part or portion of this ordinance shall
be declared unconstitutional it shall have no effect upon the validity of the
remainder of said ordinance.
