AN ORDINANCE OF ~ CITY OP BOYN~N BEACH,
P~RIDA, AMENDING ORDINANCE # 247, RESTRICTING
THE PLACING AND/OR E~CTION OF SIGNS OR ADVERTIS-
ING BY ANT REAL ESTATE BROKER OR SA~; PRO-
VIDING CERTAIN EXCEPTIONS FOR REAL ~~ BROKERS
AND/OR SALESNEN; EXENPTING PROPERr/T OWNERS FRON
THE PROVISIONS HEREOF, AND PROVIDING A PENALTY
THEREFOR.
BE IT ORDAINED BY THE CITY CO~CIL OF THE CITY OF BOYNTON BEACH,
P~RIDA, AS FOLLOWS:
SECTION 1: That after the effective date of this
Ordinance,'it shaIt he unlawful for any firm, corporation or
individual engaged in the business of selling and/or leasing
real estate for others, whether the same be a real estate broker
or a real estate salesman, as defined in the Real Estate License
Law in the State of Florida, to place, erect or cause to be
erected on any lot, parcel of .land, building or structure with-
in the corporate limits of the City of Boynton'Beach any si!~a
or similar advertisement offering real estate for sale{ ex-
change or lease except as specifically amthorized herein.
S$CTION 2:. That this Ordinance 'shall not apply to
sig~s at or upon the office or place, of business of any real
estate broker. ~
SECTION 3: That any real estate broker may place
siqns or advertisements upon subdivisions sad real estate
developments, provided:
(a) A plat of the $mbdivisiom or development is first
placed on file in the office of the Clerk of the City
of Boyaton Beach.
(b) Only the exclusive agent of the developer and/or
owmer of the property shall be authorized to place his
siqn on the property. This exclmsive agency mast be in
writing, si~aedby the owner or developer, amd placed
on file in the office of the Clerk of the City of Boynt°n
Beach, prior to the erection of the agent's sigm.
(c) Such subdivision or development shall consist ef
not less than five acres of land,- inclmding streets
and alleyways withim the-platted bommdaries of such
development or ~ .dzvzszom.
(d) This authorization shall apply only to simms
advertising the entire subdivision or development and
not to siRm advertising individmal lots within sub-
divisions aad developments.

(e) The exclusive agent of the owner of apartment
houses of two or more units shall be permitted to
place his sign on the premises advertising such
property for rent, provided that a siqned copy
of the exclusive agency first be filed in the office
of the Clerk of the City of Boynton Beach.
(f) The exclusive agent of the owner or lessee of
business property, both unimproved and improved,
located within the boundaries of the business zones
of this ' ~
c~y shall be permitted to place his sign
on the premises advertising the premises, or any
portion thereof, for rent provided that a signed
copy of the exclusive agency be first filed in the
office of the Clerk of the City of Boynton Beach.
SECTION 4: Thai none of the provisions of this
Ordinance~ly to an owner placing signs upon his own
property. ~

SECTION 6: That all ordinances or parts of ordinances
insofar as~ be inconsistent or in conflict ~ith the
provisions of this ordinance, be and the same are hereby repealed.
SECTION 7: That any corporation, firm, agent or person
violating any sec-~on or sections of this ordinance shall be deemed
guilty Of a misdemeanor and subject to a fine not to exceed One
Hundred ($100.00) Dollars or by imprisonment for a term not to
exceed thirty (80) days or by both such fine and imprisonment
within the discretion of the Nunicipal Judge.
