AN ORDINANCE cIr oF BO ON
BEACH TO VACATE PORTIONS OF THE SUB-
DIVISION OF ARDEN P~RK AS RECORDED
IN PL~T BOOK ~,, PAGE 96,
'~REAS, the original plat of Arden Park, a subdivision
to the City of Boynton Beach, Palm Beach County, Florida, was
filed in the Public Records of Palm Beach County in Plat Book ~.,
at page 96, and all of the right of ways and area designated
"Park" was accepted by the City of Boynton Beach for public
uses, and,
WheREAS, abutting lo±s 41, 42, 48, 44, 45, 46, 65, 66,
67, 70, 71 and 72 of said Arden Park there was reserved an area
marked "Park" abutting also the right of way of N. E. 3rd Street
(formerly Australian Boulevard), and that the said right of way
of N. E. 3rd Street when improved by surfacing and paving for

"Park" and that it is now the desire of the City of Boynton Beach
to vacate that portion of the right of way of N. E. 3rd Street
that abuts said lots referred to in this paragraph, as well as
the area designated "Park" and to reserve therefrom a right of
way 5'0 feet in width extending and being parallel with the re-
maining portion of said N. E. 3rd Street, and
WqtEREAS, there exists an alleyway that the City of
Boynton Beach deems the s~me unnecessary and that the said alley-
way will not be paved to serve any public use and at the request
of the property owners of lots 20, ~.1, 26 and 27, for abandor~ment
of so much of the alleyway as abuts said lots, and it is deemed
advisable to abandon said alleyway for public interest,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF TiqE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS:
The City Con~ission of the City of Boynton Beach, Florida,
does hereby determine that the "Park" area and that portion of
N. E. 3rd Street (formerly Australian Boulevard) that abuts lots 41,
42, 43, 44, 45, 46, 65, 66, 67, 70, 71 and 72, of said Arden Park
and the City of Boynton Beach does vacate the said area designated
as "Park" and the right of way of N. E. Srd Street as abuts said
lots herein mentioned. Hov~ever, reserving ~rom said a~ea that are
hereby being abandoned, a right of way wi~ich shall be deslcma ed
as N. E.3rd Street, being a right of way 50 feet in width and
continuing to boundary lines parallel to the remaining portion of
N. E. 8rd Street so tha~ the same ~s a straigh± roadway and does
dedicate the same for public right of way and public utility

The City Commission of the City of Boynton Beach,
Florida, does hereby determine tha~ the said alleyway abutting
lots 20, 21, 26 add 27 is hereby vacated and abandoned and
determine the same to be of no further uses to the City of
Boynton Beach, or for the general public and that it would
serve best use to the property owners abutting same for
proposed development.
