AN ORDINANCE OF THE 'CITY OF BOYNTON BEACH ES-
TABLISHING A'BULKHIJAD LINE FOR BULKHEADING INTO
THE WATERS OF LAKE WORTH AND PROVIDING FOR SECURING
OF PERMITS AP OF ELEVATION- REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND PROVIDING A
PENALTY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, AS
FOLLOWS:
SECTION 1: There is hereby established a bulkhead line
within the City Limits of the City of Boynton Beach for all properties
located within the said City.in accord with the diagram attached hereto
marked "Exhibit A% being Map #R-56-006, entitled 'Bulkhead Line of
City of Boynton Beach, Florida; dated September 1956. There shall be
no bulkhead, sea wall or other structure for land filling into the
waters of Lake Worth which shall extend eastward from the existing
shore line other then as shown on the map herein refereed to.
SECTION 2: It shall be required, prior to commencing
any operation for land filling within the area as shown on the
map described in Section 1 hereof, a permit for said land filling
all of which shall be in accord with directions and approval by the
City Commission of the City of Boynton Beach, Florida. The said im-
provement, or fill, shall have a minimum elevation of not less than
6-feet above mean sea level according to the U, S. Government Geodetic
Survey.
SECTION 3: SEPARABILITY.
I It is the intention of the City Council that each separate
provision of this ordinance shall be deemed independent of all other
provisions herein, and it is further the intention of the City Council
that if any provisions of this ordinance be declared to be invalid, all
other provisions thereof shall remain valid and enforceable.
I SECTION 4: REPEALING PROVISIONS.
All ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 5: PENALTIES.
Any person, firm or corporation convicted of the violation
of any of. the terms or provisions of this ordinance may be fined in a sum
not to exceed $500.00 or may be imprisoned for not more than ninety-(90)
days, or may be both fined and imprisoned within the discretion of the
Trial Court.
