84-MMA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, URGING THE PALM BEACH COUNTY COMMISSION TO ENACT AN ORDINANCE TO PROVIDE FOR A 10 DAY "COOLING OFF" PERIOD IN THE PURCHASES OF HANDGUNS; PROVIDING FOR AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, handguns are used in committing numerous crimes; and WHEREAS, handguns often fall into the hands of those persons with criminal records so they may commit more crimes upon innocent citizens; and WHEREAS, present state and federal regulations are inadequate and do not preempt this field; and WHEREAS, the voters of Palm Beach County have expressed their approval of a cooling off period for purchase of handguns as evidenced by the results of a straw ballot held March 13, 1984, wherein 102,134 persons voted in favor and only 16,218 voted in opposition~ and WHEREAS, past history has shown these handguns to be used during periods of mental anguish and anger that tend to moderate with the passage of time. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. The City Council of the City of Boynton Beach, Florida, does hereby go on the record as favoring a ten (10) day "cooling off" period between the actual purchase of a handgun and its delivery. This period shall also serve as time for a criminal record review of the purchaser by the appropriate law enforcement officials prior to the purchaser obtaining the handgun. If the purchaser has a criminal record or is otherwise disqualified from obtaining a handgun, he cannot receive approval for delivery of the handgun and the sale shall be invalidated. Section 2. The Board of County Commissioners of Palm Beach County is urged to enact an ordinance to further the intent and purpose of Section 1 of the Resolution. Section 3. Copies of this Resolution shall be mailed to the Board of County Commissioners of Palm Beach County, Florida. Section 4. diately upon its passage.
