84-HA RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, PROVIDING
FOR THE CONSTRUCTION AND/OR REBUILDING
OF APPROXIMATELY 180 FEET OF SOUTHEAST
THIRD STREET LYING NORTH OF SOUTHEAST
TWENTY-FIRST AVENUE IN THE CITY OF BOYNTON
BEACH, FLORIDA~ PROVIDING FOR THE ASSESS-
MENT OF THE COSTS THEREOF AND THE MANNER
IN WHICH SAID ASSESSMENTS SHALL BE MADE;
WHEN SAID ASSESSMENTS ARE TO BE PAID;
DESIGNATING THE LANDS UPON WHICH THE
SPECIAL ASSESSMENT SHALL BE LEVIED;
ESTIMATED COSTS; FILING OF ASSESSMENT
PLAT, PLANS AND ESTIMATE OF COSTS; PUBLI-
CATION; AND FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Boynton Beach,
Florida, has determined that it is necessary and in the public
interest to construct and/or rebuild a portion of approximatei~
180 feet of S.E. Third Street, lying north of S.E. Twenty-first
Avenue; and
WHEREAS, the City Council of the City of Boynton Beach,
Florida, has determined that the cost of said improvements
shall be assessed against the adjoining property owners.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: Pursuant to the provisions of Chapter 170,
Florida Statutes, the City Council of the City of Boynton Beach,
Florida, does hereby determine that it is advisable to make
certain improvements including the construction and/or rebuilding
of approximately 180 feet of S.E. Th±rd Street, lying north of
S.E. Twenty-First [Avenu~ located in the City of Boynton Beach,
Florida, so as to improve the same.
Section 2: The cost of said improvements shall be
defrayed by assessment against the adjoining property owners.
Said assessment shall be determined by the cost of said improve-
ments assessed on a front footage basis, charging each adjoining
property owner.his proportionate share as divided by the total
improvement cost.
Section 3: Within sixty (60) days after final
completion of the improvements and acceptance thereof by the
City, the property owners to be assessed will be notified of
the completion and advised as to the actual amounts due. The
special assessment against each lot may be paid in any one of
the following manners:
(a)Any such assessment may be paid in full
within ninety (90) days from the date
of confirmation thereof, without interest.
(b) In ten (10) equal consecutive semi-annual
installments, together with interest at
the rate of eight (8%) per cent per annum,
from the expiration of said ninety (90)
days, in each of the succeeding years
with payments due June 30 and December 30
of each year, provided that any assessment
may be paid at any time before due,
together with interest accrued thereon to
the date of payment.
Section 4: The property upon which the special
assessment shall be levied is all lots and lands adjoining,
contiguous, or abutting upon such improvements, and benefitted
thereby and further designated by the assessment plat hereinafter
provided for.
Section 5: The total estimated cost of the improvement
program is nine thousand ($9,000) dollars, and all program
improvements are to be paid by special assessment.
Section 6: There shall be on file with the City
Clerk of the City of Boynton Beach, Florida, an assessment plat
showing the area to be assessed with plans and specifications
and an estimate of the cost of the proposed improvements. Said
assessment plat, plans and specifications are open to the public
for inspection.
Section 7: This Resolution shall be published one
time as required by law.
Section 8: This Resolution shall become effective
immediately upon its passage.
