83-LLLLRESOLUTION NO. 83~.~- A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF BOYNTON BEACH~ FLORIDA APPROVING AND AUTHORIZING THE EXECUTION OF THE RENEWAL OF LIBRARY SERVICE AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND THE PALM BEACH COUNTY BOARD OF COUNTY COMMISSIONERS ON BEHALF OF THE PALM BEACH COUNTY LIBRARY TAXING DISTRICT. NOW~ THEREFORE~ BE AND IT iS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. That the Mayor and City Clerk are hereby authorized and directed to execute on behalf of the City of Boynton Beach~ Florida~ the Renewal of Library Service Agreement between the City of Boynton Beach and the Palm Beach County Board of County Commissioners on behalf of the Palm Beach County Library Taxing District. RENEWAL OF LIBRARY SERVICE AGREEMENT This Agreement between the City of Bo_9_y_~ton Beach and the palm'Beach County Board of County Commissioners on behalf of the Palm Beach County Library Taxing District, is entered into this day of , 1983, for the purpose of rene~ing the ~'LIBRARY SERVICE AGREEMENT" through September 30, 1984. WHEREAS, the City of Boynton Beach and the Palm Beach County Board of County Commissioners entered into a Cooperative "LIBtLARY SERVICE AGREEMENT° which was in force 'through September 30, 1983; and WHEREAS, the City of Boynton Beach and the Palm Beach County Board of Count~' Commissioners wish to renew the "LIB?~ARY SERVICE AGREEMENT" through Sep(er~)er 30, 1984. DUNKLE, Clerk Deputy Clerk (SEAL) Witnesses: BOARD OF COUNTY COMMISSIONERS BY Chairman CITY OF BOYNTON BEACH, FLORIDA BY Mayor ATTEST: City Clerk APPROVED BY (SEAL) SERVICE AGREEMENT AS FOLLOWS: WHEREAS, pursuant to Special Act of the Legislature, Palm Beach County has established a ~axing district for the purpose of providing a free, uub!ic library system, and WHEREAS, the library district boundaries are ~efined as those areas of the County that are not already taxed for library purposes, and WHEREAS, the Board of County Commissioners of Palm Beach County wish~s to make municipal library services available to taxing district 'residents and in return, provide municipal residents with services avail, able from the library district, and WHEREAS, the City Council of--~~N'. ~d~ wishes to, participate in and support a Palm Beach County Cooperative Library System by making it's facilities available to Library Taxing District residents and in return receiving services from the cooperative system, and WHEREAS,-there will be an Ad~ministrative Co~Tm~ittee of ~e-Palm Beach County Cooperative Librar. ff System, herein refemred to as the "Co]mmittee". This con~mittee will be made up of the Directors of the participating libraries. WHEREFOPJE, PALM BEACH COUNTY, A POLITICAL SUBDIVISION OF TEE STATE OF FLORIDA, HEREIN REFERRED TO AS "COUNTY" and ~~'~ ! HEREIN P, EFERRF. D TO AS "CITY" AGREE 1. The County will purchase in FY 81/82 Thirty Five Thousand ($35,000) Dollars worth of lease book services for the benefit of the municipalities participating under this or similar agreements. The County further will purchase Forty Thousand ($40,000) Dollars worth of permanent library ]nateria! to be'placed in the participating municipal libraries. The 'Committee" will have the responsibility for.the equitable distribution of the lease books and the library material. The selection of material for purchase or lease will be done by the staffs of the participating libraries. All permanent library material placed in the participating municipal libraries pursuant to this agreement shall at once and forevermore become the exclusive property of the pa~:ticipating municipal library. The remaining Twer~ty One Thousand Seven Hundred ($21,700) Dollars would be used to J~' .~tiate ti~e automated system in the member !ibrar~es or to support other agreed upon mutually ~enefici~a! programs. 2. The City agrees to register and serve'a!l taxing district residents and residents of all other participating libraries on the same basis and terms as residents of the City. 3. The County agrees to register and serve res'idents of the participati'ng City's library on the same terms and conditions as residents of the library district. 4. The County .agrees to provide books-by-mail service to City residents not able to come to a library on a basis agreed to by the County and the City. 5. The County agrees to extend use of its 16rmm film co!!edtion to the City Library and 'to individuals from that city and will seek the participation of the "ConLmittee" in previewing $ and selecting films. 6. The County a~rees to n.egotiate the best possible discount for books and processing in which all mem~oers may participate. 7. The County agrees to provide courier service to the City at an appropriate level decided by the "Committee'~. 8. The City agrees to maintain an accurate record Of library district residents that are registered with the City for use of.its library. 9. The County agrees to maintain an accurate record of City residents that are registered with the library district for use of its services. 10. The term of this Agreement shall begin on the day executed and terminate on September 30, 1982.
