THIS AGREEMENT, made and entered into this 6th day of December , A,D., 1983, by and between: THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY, FLORIDA, a political subdivision of the State of Florida, hereinafter referred to as the "County "; and THE CITY OF BOYNTON BEACH, FLORIDA, a municipal corporation existing under the laws of the State of Florida, hereinafter referred to as the "City ". W I T N E S S E T H: WHEREAS, Section 316.006(2), Florida Statutes, grants muni- cipalities original jurisdiction over all streets and high- ways located within their boundaries, except State roads, and grants said municipalities authority to place and main- tain traffic control devices which conform to the Manual on Uniform Traffic Control Devices for Streets and Highways and specifications of the State Department of Transportation uDcn all streets and highways under their original jurisdic- tion, as they shall deem necessary, to indicate and to carry out the provisions of Chapter 316 or to regulate, warn, or guide traffic; and WHEREAS, the County presently has traffic engi- neering expertise and technical capability as authorized by Section 316.006(3), Florida Statutes; and WHEREAS, the County has determined that central- izing the installation, operation, and maintenance of traf- fic control devices on the major roadways throughout Palm Beach County, Florida, in one responsible governmental entity is the most economical and efficient means of pro- viding such needed services; and WHEREAS, in furtherance of the centralization of mutual traffic functions, the City has agreed to transfer and the County has agreed to accept certain authority, -1- powers, respons..bil'.t'_ anc duties as enumerated her :ormerly :cercised by the City pertal.ning to the planning, installation; operation and maintenance of traffic control devices on certain roadways and signalized intersections in accordance with the terms and conditions of this Agreement; and WHEREAS, as a part of the consideration for the entering into of this Agreement, the County has agreed to assume the current funding obligation for the continued operation of the traffic design and signalization respon- sibilities transferred hereunder,pursuant to the terms of this Agreement; and WHEREAS, Section 125.01(p), Florida Statutes, authorizes the County to enter into agreements with other governmental agencies within or outside the boundaries of the County for the performance of the County of certain of the City's authorized functions. . NOW, THEREFORE, IN CONSIDERATION of the premises and mutual covenants hereinafter contained, the parties do agree as follows: 1. TRANSFER OF FUNCTIONS AND DUTIES The City agrees to transfer to County, and the County agrees to accept and perform the following functions and duties on certain major roadways and signalized inter- sections in order to protect the welfare of the public, which functions and duties were formerly performed by, or the responsibility of the City. (a) Install stop or yield signs necessary to govern traffic. (b) Maintain, operate and upgrade as necessary existing traffic signals. (c) Install, maintain and operate new traffic signals where warranted (City Council approval will be required prior to the installation of a traffic signal at the intersection of two City streets), and City Council approval will be required prior to the removal of any traf- fic signal covered by this Agreement. (d) Prohibit or restrict traffic movements including left, right and U turns. (e) Install and maintain traffic markings including crosswalks, safety zones and traffic lane striping. -2- ) Designate one -way streL._s. (g) Establish no-parking, no- standing, and no- stopping regulations. (h) Establish emergency and experimental regulations. (i) Establish on- street truck and passenger loading zones. (j) Establish speed limits. (k) Establish no passing zones. (1) Establish traffic control guidelines for all roadway construction and maintenance operations. (m) Prohibit use of streets by trucks. (n) Establish bridge loading restrictions. The County shall perform the above - described func- tions and duties provided, however, the County may assign to its Division of Traffic Engineering or any successor divi- sion which may be created, such ministerial tasks as it deems appropriate. The County shall be fully responsible for all items delineated in paragraphs (a) through (n) above, and the City shall have no duties or obligations whatsoever with regard to items delineated in paragraphs (a) through (n) above. All signs, signals, and markings and the placement thereof shall be in conformance with the Manual on Uniform Traffic Control Devices for Streets and Highways published by the State Department of Transportation. 2. ROADWAYS AND INTERSECTIONS AFFECTED The transfer of functions and duties described in Section 1 above shall apply only to all signalized intersec- tions and the following roadways: ROAD LIMITS (a) Miner Road Within City Limits (b) Seacrest Boulevard Within City Limits (c) Golf Road /S. 23rd Avenue Within City Limits (d) Congress Avenue Within City Limits (e) Swinton Avenue Within City Limits (f) Old Boynton Road Within City Limits (g) Old Dixie Highway Within City Limits (h) N. 22nd Avenue Within City Limits -3- r,. such time that any roadway within the City which is currently under the jurisdiction of the State of Florida is turned over to the County for maintenance and the County receives written notification thereof from the City, then that roadway shall be considered included in this Agreement. The existing signalized intersections affected follow: (a) N. 10th Avenue and N. Seacrest Blvd. (b) N.W. 22nd Avenue and N. Congress Avenue (c) N.E. 4th Avenue and N. U.S. #1 (d) W. Seacrest Blvd. (Flasher) . -4- RETENTION BY THE CITY ( FUNCTIONS AND DUTIES NOT TRANSFERRED It is specifically understood and agreed that all rights and powers as may be vested in the City pursuant to Chapter 316 of the Florida Statutes or any other law or ordinance or Charter provisions of the City and not specifi- cally transferred to County hereunder shall be fully retained by the City. It is further understood and agreed that the City is not transferring any of its traffic enfor- cement functions, rights and duties together with all rights of enforcement of City traffic ordinances or State traffic statutes. 4. TRANSFER OF OWNERSHIP OF TRAFFIC CONTROL DEVICES' The City transfers ownership to the County of all traffic control devices presently installed within and owned by the City within the roadways involved in this Agreement. The existing traffic signals involved are those listed in Section 2 of this Agreement. 5. PAYMENT OF UTILITIES FOR TRAFFIC CONTROL DEVICES County agrees to be responsible for and to pay uti- lity bills for traffic control devices enumerated in Section 2 of this Agreement. 6. COUNTY TO PROVIDE NECESSARY FINANCIAL SUPPORT UNDER AGREEMENT The County agrees to provide in its annual budget the financial support necessary for the purposes set forth in this Agreement. 7. APPLICATION FOR STATE AND FEDERAL GRANTS BY COUNTY The City agrees to allow the County to apply for and accept any State or Federal Grants, loans, or other programs, which may become available to the County by virtue of the transfer of this function from the City to the County. 8. CITY ORDINANCES TO CONFORM TO AGREEMENT The City agrees to make whatever changes to its code of ordinances that are necessary to fully implement the provisions of this Agreement. -5- 9. RE JESTS O? THE CITY __abject '_o budgetary and financial considerations, the County and the Traffic Engineering Division of the County agree to implement all reasonable written requests of the City promulgated by Resolution of the City Council for the installation, retention, or removal of traffic control devices within the City and further agree to implement all reasonable requests of the City with regard to any of the duties and functions specified in paragraph 1 above, so long as such requests accord with the Manual on Uniform Traffic Control Devices for Streets and Highways and specifications of the State Department of Transportation and commonly accepted standards of traffic engineering. 10. CANCELLATION This Agreement may be cancelled by the City or County upon ninety (90) days formal written notice. In the event of any cancellation the parties agree that the traffic signals shall remain at their respective locations subject to the following: (a) Signals owned prior to this Agreement by the City shall become City property and subject to City ownership and control thereafter. (b) Signals originally owned or constructed • by the County may be purchased by the City upon notice to that effect from City to County within sixty (60) days from date of cancellation. If the City desires to retain these signals it shall pay the County for the County's original cost thereof, including installation charges, minus a depreciation factor of one -tenth (1 /10) of the original cost per year to be deducted from such cost. Cheney City Manager v RE: Traffic Engineering Service Agreement This memo provides an update to my previous memo of September 21, 1983, concerning subject agreement. Pursuant to a decision by the County Traffic Division, three additional County- maintained roadways have been included in the proposed agreement: Old Boynton Road, Old Dixie Highway and North 22nd Avenue; (Gulfstream Boulevard does not yet meet the criteria of having been included in the County's adopted Thoroughfare Plan). This agreement also would cover all twenty -eight traffic signals located within the City, including the remaining seven not yet under a Municipal Signal Assistance Program (MSAP) Agreement. Therefore, adoption of this agreement would relieve the City of signi- ficant annual electrical and maintenance costs. It is suggested that the proposed agreement be adopted by resolution at the next regularly scheduled City Council meeting in order to take advantage of the poten- tial savings. All roadway and signalization maintenance and upgrading will be in conformance with the latest specifications and will utilize state - of- the -art equipment and techniques; 2. Traffic signal synchronization improvements would provide greater efficiency in controlling traffic flow, thereby minimizing stops and, as a consequence, reducing vehicle fuel consumption and wear; 3. Further standardization and the use of the latest solid -state com- ponents should result in less maintenance, fewer problems, and there- fore a safer environment for both motorists and pedestrians; Peter L. The County's ability to apply for and receive available transpor- tation grants and loans is enhanced and concerns over dual- taxation for these facilities are mitigated. Inasmuch as the County's Traffic Engineering Division is highly regarded in the transportation management field, it would appear to be advantageous to the City to relinquish these responsibilities to their expertise, while at the same time reducing City expenditures in this area. This agreement covers all twenty -eight traffic signals located within the City, including the remaining seven signals and flashers not yet covered by the Municipal Signal Assistance Program (MSAP) agreements. This agreement also includes the five County roadways listed on page three, portions of which are located within the City limits. Box 310 Boynton Beach, FL 33435 SUBJECT: Traffic Engineering Services Dear Mr. Cheney: Palm Beach County has agreements with other municipalities in the County to provide traffic engineering services on selected major roads in the municipal limits and to maintain all traffic signals within the munici- pality. This is done at County expense and the County in return provides more cost effective services to the public. It is my understanding that our staffs have been discussing the possibility of transferring control of all traffic signals within the City to the County. In the past, it has been County policy to request that an intergovernmental agreement such as the one mentioned above be implemented. This provides a standardized central approach to traffic control countywide and has resulted in few conflicts with municipalities that have executed the agreement. In addition, the County is then responsible for future expenses involving new traffic signal installations on the roads included as part of the agreement. A copy of the standard agreement is included for your review. We have taken the liberty of including the major roads that would be affected in the City of Boynton Beach in the body of the agreement. Implementation of the agree- ment still allows the City major input regarding decisions on the affected streets and as mentioned earlier, has resulted in few problems. We would be happy to discuss this further with you or your staff as we recog- nize that you will have questions prior to making any presentation to your Commission. Costs for traffic signal electric and traffic signal maintenance (line items #001 -411- 541 -40.12 and #001 -411- 541 - 30.43, respectively) will hereafter be borne by the County and will no longer be a responsibility of the City Public Works Department. 2. Identification of North 22nd Avenue as a County- maintained right -of -way, by virtue of its inclusion in the Agreement (Sec. 2, Page 3), thereby resolving some apparent confusion in this regard. This Agreement became effective December 6, 1983, and, in effect, supersedes the previously executed Municipal Signal Assistance Program (MSAP) agreements which dealt with traffic signalization operations and maintenance at several indivi- dual intersections.
