BE IT ORDAINED BY THE CITff COL7,1CIL OF TN~ CiTY OF BOYNTON BEACH, FLORIDA: S~CTION 1. Definitions: (A} Parking lot or parking area shall mean any outdoor space or uncovered plot, place, lot, parcel, yard or enclosure, or any portion thereof, where more than five ($) motor vehicles may be parked, stored., used or kept. (B) Motor vehicle shall mean any automobile, truck, motor scooter or other self propelled vehicle not operated on tracts or from trolleys. (C) Person shall mean and include any person, firm, partnership, association, corporation, company or organization of any kind. SECTION 2. License Require___d: It shall be unlawful for any person to conduct a business -~nerein parking facilities are furnished for the parking of more than five (5) motor vehicles,within the City-of Bovnton Beach, without first having obtained a license therefore, in a manner as hereinafter set forth. '~ SECTION S. ~ication for License: Applications by any person desirous of securin~ a license shall be made to the City Clerk, or proper designated officzai as may be from time to time desig~a±ed by the City, said application shall be in writing and verified under oath by the applicant if an individual, or by duly authorized agent in a partner- ship, or corporation, setting forth the following: (a) If a oerson, name and address of applicant. (b) If a partnership, na~e,, ~ res~o, ence~ ~ and business address of each partner. (c) If a corporation, name, date and state under whose laws such corporation was organized, and names of principal officers, directors and local representatives and addre~sses. Ordinance #271 - Page A plot or drawing of said parking lot showing its iocation~ size, capacity and size of entrances and exits. The type of en±erprize or occupation which shall be conducted upon the premises. SECTION ~. Person making application for construction of parking lot shall, after furnishing to the City the information as set forth in Section 3, provide the City with a sketch of said drains for street sewers Which shall be approved by the City Co~miss- ion or their designated agent showing that the said drains are adequate to remove water without emptying ihe same O~to the streets, alleys, or roadways within ~he City of Bovnton Beach~ Ail such parking areas shall be const~acted as o~ minimum street requirements wi~h the privilege of using shell rock as base compacted wi~h exterior surface two (2) coats of oil and sand sealed. Ail drain openings shall be of an approved type sufficient to support~ the wem~t of motor vehicles and be constructed with good ~ eng~nee~!ng principals. SECTION 5. Issuance of License: if after investigation by the City of Boynton Beach, the location of the said parking lot shall be within an area approved for the type of business or occupation to be conducted thereon~ the City Council, or its designated agent shall sign a permit to be issued for the construction of the said parking lot. The City Council shall have its proper designated inspector approve the construction of the said parking lot according to plans and specifications upon the completion thereof prior to the person, firm or coyporation operating on said premises any business ~nich shall require the use of maid parking lot. SECTION 6. Entrances and Exits. Each parking !o± shall have at least one common entrance and one common exit and the location of such entrance ar lo~ations¢ shall be approved by the City Coum. cil or its designated agent. SECTION 7. All parking lots except for entrances and exits sha!i~e enclosed by barriers or sleepers which shall be constructed and maintained by the property owner suitable to the City of Boynton Beach or its designated agents. ~¢nen said lot abuts on a building, barriers shall be erected so as to prevent mo%or vehicles from striking such building. SECTION 7. Time forComplmance.' (a) All parking lots now licensed shall be given 90 days from the effective date of this ordinance to file plans for approval, and one year from date of passage of this Ordinance #271 - Page 3 ordinance for full compliance with the terms of this ordinance. (b) Ail businesses coming under this said ordinance shall not be granted occupational licenses to engage in business upon any location than the City limits of the City of Boynton Beach after October tst, 1958, unless full compliance with all terms and provisions of ±his ordinance. Each of the provisions of this Ordinance are inseparable including word, clause, phrase or sentence and if any provision shall be declared invalid, the remaining portion shall not be effected but shall remain in force and effect.
