O#269ORDINANCE #269 AN ORDINANCE OF THE CITY OF BOYNTON BEACH AMENDING ORDINANCE #205 OF THE SAID CITY; CREATING INDUSTRIAL ZONING: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH, AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY CO~4ISSION OF THE CITY OF BOYNTON BEACH, AS FOLLOWS: SECTION 1: The following designation shall hereinafter create the classification, Zone H, Industrial. This classification shall be defined as follows. In the H industrial district any building or land may be used for any purpose whatsoever not in Conflict with any ordi- nance of the City regulating nuisances; provided, however, that no ~uilding or occupancy Permit shall be'issued for any of the follow- · ng uses until and unless the location of such use shall have been approved by the board of appeals. Uses which must be approved: (1) Abattoir and meat packing plants. (9.) Acid manUfactUre. (3) Distillation of bones, coal or wood. (4) Fertilizer manufacture. (5) Garbage, offal or deal animal reduction or dumping. (6) Glue, sizing or gelatin manufacture. (7) Paper and pulp manufacture. ( 8 ) Rendering plant. (@) Soap manufacture. (10) Stock yards or slaughter of animals. (11) annlng, curmng, storage of hides and skins, and general those uses which may be obnoxious or offensive by reason of emission of odor, dust or smoke, gas or noise. If any section, subsection, sentence, clause, ~nras~'or ~n_ of this ordinance _s~ for any reason held invalid or unconsfitutionai by any CouTt of competent jurisdiction, such portionlShaI! be deemed a 'seParate, distinct and independent p~ovisi0n and such holding shall not effect the validity of the remaining portions thereof. SECTION ~: Penalties. Any Person, firm or corporation convicted of the violation of any of the terms or provisions of' this ordinance may be fined in a sum not to exceed $500.00 or may be imprisoned for not more than ninety (90) days, or may be both fined and imprisoned within the discretion of the Trial Court.
