COD-FLICTING ORDINANCES, PROVIDING PENALTY FOR VIOLA-
TION HEREOF.
BE IT 0RDAI~D BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH,
FLORIDA:
SECTION !: Section !! of Ordinance # 235 is hereby amended
to read as follows:
Engaging in business without license or under a license
issued upon false statement; oenalties.
It shall be unlawful for any oerson to engage in any trade~
business, orofession or occupation within the city without a license
as aforesaid, or upon a license issued upon false statements made by
any person~ or in his behalf. Any person engaEed in any trade,
business~ orofession or occuoation within the city without a license
or under license issued uDon false statements made by such person,
or in his behalf~ shall and is hereby required to DaY the following
oen~lties in addition to the license fees hereinabove provided for.
Ail licenses shall expire and become delinquent after a 12 month
oeriod ending October 31, for the year in which the same w~s issued~
all licenses hereby shall become delinquent and renewals shall be had
on or before October 31 for the next ensuing license year.
Any license not renewed on December 15, 20~ of original
licnese fee.
ACter December 31 licensee shall have been ae~ermmned in
violation hereof and ooerating a business without current license~
sh~ll be orima facie guilty hereunder.
In addition to the ~o_egoing oena!ties hereinabove orovided
for~ any person engaged in any trader business, profession or occuoa-
tion within the city without a license or under a license issued upon
fsIse statement made by such oerson, or in their behalf~ shall upon
cohviction thereof, exceot as may be otherwise orovided herein~ be
fined not more than $~00]00 or imorisoned in the city orison not to
exceed a oeriod of thirty (30) days~ or may be both so fined and im-
orisoned within the discretion of the Court.
In any prosecution under this chaoter, the fact that such
zor business, shall be orima facie evidence of engag-
~erson is open ~
ing in such trade~ business~ orofession or occupation~ and the burden
shall be upon the defendsnt t~ rebut the same.
Each day or oart of s day that this Ordinance is viotsted
shall constitute a separate and distinct offense for which such
oerson or his agents~ servants or employees may be prosecuted.

SECTION 2: Section 13 of Ordinance # 3~ is hereby amended
in cart, changing the following license fees from the amount originalm
ly set forth in the original 0ccupatio~.al License Ordinance above
numbered to be as follows.
The amounts for the following named sub-contractors shall be
amended~ and each oerson, firm or corooration, or association, engaged
in~ or managing businesses or occupations, as sub-contractors, a
license fee of $25.00 shall be paid for each of the following seoarate
distinct businesses: Paving contractor, Electircal contractor, ?lumb-
lng contrsctor~ Masonry contractor~ Plastering contractor, ?ainting,
Electric Sign, Moving and Wrecking~ Roofing ~nd Sheet Metal~ Refriger-
ation~ Tile and Terrazzo, Tile, Glazing, Structural Steels~ Flooring~
Elevator, L~ndscaping~ Ornamental metals, Sign ~ainting~ Solar Heating~
Fire Sprinkler, Sprinkler and Well Drilling, Awning, Seotic tank, and
all other contractors not herein mentioned~ or specific~!iy set out in
original ordinance~ above referred to~ shall be $2~00.
The definitions under which each of the above and foregoing
named sub-contractors shall be bound is as originally set forth in
Ordinance #23~
SECTION 3: Before the City of Boynton Beach~ Florida,
shall be required to issue a license for engaging in or carrying on
any of the busi~esses~ professions or occupations soecified and set
forth herein, it shall be the duty of the aoplicant to file an appli-
cation with the City Ts× Collector~ such application to be in the form
required by the City Co~mission of the said City of Boynton Beach, and
such applicant shal~ be required to furnish to the C~ty Commission such
other information not contained in the application as the said City
Commission may require.
SECTION 4: &ll Ordinances or carts of Ordinances in conflict
herewith~ are hereby repealed.
SECTION ~: This Ordinance shall be and is hereby decisred
to be an emergency measure on the ground of urgent need for the pre-
servation of oeace, health and safety of the oeo~le of the City of
Boynton Beach.
SECTION 6: This Ordinance shall be in ful~_~ ~ force and effect
i~nediately uoon its oassage and adoption°
SECTION 7: SEPARABILITY. If any section, sub-section,
sentence, clause, phrase or oortion of this Ordinance is for any reason
held invalid or unconstitutional by any court of competent jurisdiction~
such portion shall be deemed a seoarate~ distinct ~nd indeoendent oro~
vision and such holding shail, not effect the validity of the remaining
oortions thereof.

SECTION 8. PENALT/ES. Any person~ firm or corporation
convicted of the violation of any of the terms or provisions of this
ordinance may be fined in a sum not to exceed $~00. OO or may be im-
prisoned for not more than ninety (90) days~ or may be both fined
end imprisoned within the discretion of the Trial Court,
