A RESOLUTION OF THE CITY OF BOYNTON BEACH,
FLORIDA, AUTHORIZING THE CITY OF BOYNTON
BEACH STAFF TO PARTICIPATE WITH THE MIAMI
DADE WATER AND SEWER AUTHORITY IN 'A PROGRAM
TO PREPARE AND SUBMIT APPLICATIONS FOR 301
(h) VARIANCES AND TO AUTHORIZE THE MIAMI
DADE WATER AIqD SEWER AUTHORITY TO SELECT THE
CONSULTING ENGINEER TO ASSIST IN THE PREPARA-i!
TION OF SAID APPLICATIONS.
WHEREAS, the United States Environmental Protection
Agency has a proposed amendment to Section 301 (h) of Public Law
92-500 titled, "Modification of Secondary Requir, emeSts~[fforliii~is~Char¢
into Marine Waters"; and
WHEREAS, the proposed amendment defines requirements -~.~.
for completing variance applications for reduced secondary treatme~
levels which could result in considerable savings in capital,
operating and maintenance cost to each utility receiving a variance
and
WHEREAS, outfalls on the edge of the gulfstream will be
eligible to apply for the proposed variance; and
WHEREAS, other utilities in Southeast Florida may partici
pate in a joint program to reduce application costs; and
WHEREAS, said applications must be submitted before
December 29, 1982. Within this tight time restraint, the Miami
Da~e Water and Sewer Authority will accept proposals, select a
consulting engineer in accordance with Chapter 73-19, Laws of
Florida Consultants Competitive Negotiation Act, to prepare the
variance applications and allow other utilities to negotiate a
price with said engineer for their individual needs;
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That the Staff is authorized to participate
in the program with the Miami Dade Water and Sewer Authority and
other Southeast Florida Utilities for submittal to the U. S.
Environmental Protection Agency of a 301 (h) variance waiver
application for the City of Boynton Beach Wastewater Treatment
(s) and outfall(s).

Section 2. That an allocation not to exceed thirty
thousand dollars ($30,000) be approved for the work required to
complete an application for variance.
Section 3. That we hereby authorize the Miami~Dade Wate
add Sewer Authority to accept responses to a Request for Proposal
for the work and to select a consulting engineer in accordance
with Chapter 73-19, Laws of Florida, Consultants Competitive
Negotiation Act.
