82-QQRESOLUTION NO. RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS PURSUANT TO FLORIDA STATUTE ~171.062 TO REZONE LAND BEING ANNEXED TO THE CITY OF BOYNTON BEACH FROM THE COUNTY ZONING CLASSIFICATION A-G (COMPREHENSIVE PLAN - COMMERCIAL) TO THE CITY ZONING CLASSIFICATION OF C-3 (COM>PtrNiTY COMMERCIAL, LAND USE ELEMENT LOCAL RETAIL). WHEREAS, the City of Boynton Beach has received a reque for annexation from First American Bank of Palm Beach County, as agent of the owner, H. Irwin Levy, of the following described property: A parcel of land lying in Section 19, Township 45 South, Range 43 East, Palm Beach County, Florida, being more particularly described as follows: Commencing at the Southeast corner of said Section 19; thence N 00° 59' 39" W a distance of 1242.20 feet to - a point; thence N 89© 46' 34" W a distance of 50.01 feet to a point on the West right-of-way line of Congress Avenue (S.R. 807); thence N 00© 59' 39" W along said West line a distance of 2145.01 feet to a point; thence S 88° ~05' 26" W a distance of 10.00 feet to the principal point and place of beginning of the following Description: Thence continuing S 88© 05' 26" W a distance of 328.87 feet to a point; thence N 00© 59' 39" W a distance of 472.86 feet to a point on the South line of Boynton Canal; thence N 88° 05' 26" E along said South line ~a distance of 328.87 feet to a point; thence S 00° 59' 39" E a distance of 472.86 feet to the point of the beginning and containing 3.57 acres of land more or less, but subject to all legal highways and easements of record. WHEREAS, the City Countil at the May 18, 1982, regular meeting, considered this annexation request, and upon the recommendation of the Town Planner, City Zoning Board and Technit Review Board determined that the proper zoning for this parcel $~ land would be the City's Zoning Classification C-3 (Community. ~ommercial, Land Use Element Local Retail); and Il ~4~EREAS, pursuant to Chapter 171.062 of Florida Statutes, City of Boynton Beach requests that the Board of County Commissioners consent to the City of Boynton Beach rezoning the above-described property from County Zoning Classification A-G (Comprehensive Plan - Commercial) to the City Zoning Classification of C-3 (Community Commercial, Land Use Element Local Retail) upon its annexation. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests permission to rezoning, when annexed, the property described above, from A-G to C-3. Section 2. That a certified copy of this Resolution be sent to the Board of County Commissioners of Palm Beach County, the County Administrator, and the County Director of Planning, Zoning and Building.
