A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, VACATING
AND ABANDONING A SPECIAL PURPOSE UTILITY
EASEMENT LOCATED IN THE WEST THREE FEET
OF LOTS 9 AND 10 OF SUNSET COURT
SUBDIVISION AS RECORDED IN PLAT BOOK 11,
PAGE 29 OF THE PUBLIC RECORDS OF PALM
BEACH COUNTY, AUTHORIZING THE MAYOR ~ND
CITY CLERK TO EXECUTE A DISCLAIMER FOR
SAID EASEMENT, AND FOR OTHER PURPOSES
WHEREAS, George and Joanne Cummings, Jr., requested
the abandonment of the abovementioned special purpose easement.
WHEREAS, commen~s have been solicited from the
appropriate City Department.
WHEREAS, Public Hearings have been held by the City's
Planning and Zoning Board, and the City Council on the proposed
abandonment.
WHEREAS, based upon the foregoing information that the
existence of said easemen~ is no longer necessary for City
purposes.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, that:
Section 1. The City of Boynton Beach, by and through
its City Council, does hereby vacate and abandon a special
purpose utility easement situated and being in the City of
Boynton Beach, on a piece of property described as follows:
The West 3 feet of Lots 9 and 10 of Sunset Court
Subdivision as recorded in Plat Book 11, Page 29
of the Public Records of Palm Beach County.
Section 2. That the Mayor and the City Clerk are
hereby authorized and directed to execute and deliver the attach
disclaimer and cause the same to be filed in the Public Records
of Palm Beach County.
Section 3.
effective immediately upon its final passage.
