A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BOYNTON BEACH, FLORIDA~ REQUESTING COORDINA-
TION OF PLANNING EFFORTS BETWEEN THE CITY OF
BOYNTON BEACH AND PALM BEACH COUNTY IN THOSE
AREAS WITHIN THE RESERVE ANNEXATION AREA OF
THE CITY OF BOYNTON BEACH; WITHIN ONE MILE OF
THE CITY OF BOYNTON BEACH OR ANY AREA THAT MAY
BE REASONABLY ASSUMED THAT MAY BE ANNEXED INTO
THE CITY LIMITS OF THE CITY OF BOYNTON BEACH
AND A REQUEST THAT THE CITY CLERK FORWARD A
COPY OF THIS RESOLUTION TO THE COUNTY PLANNING
AND ZONING DIRECTOR, COUNTY ADMINISTRATOR AND
COUNTY COMMISSIONERS; AND FOR OTHER PURPOSES.
WHEREAS, it is recognized that comprehensive planning
for an area is the responsibility of all governmental entities
within that area; and
WHEREAS, it is recognized that proper planning for an
area cannot 'be conducted on the basis of artificial lines between
an incorporated municipality and an unincorporated county without
cooperation between the County and Municipal Governments; and
WHEREAS, coordination between these governmental units
is necessary in order to provide proper police and fire protection
water and sewer services and other governmental services; and
WHEREAS, the need for intergovernmental cooperation is
recognized in the Local Governmental Comprehensive Planning Act
(Florida Statutes Chapter 163) and the Comprehensive Plans of
Palm Beach County and the City of Boynton Beach.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. A formal request is hereby made to the Palm
Beach County Commission, Commission Staff, Palm Beach County
Planning and Zoning Department and the County Administrator that
the City of Boynton Beach Planning Department be immediately
notified of any request for a zoning change, special exception or
request and/or approval of subdivisions within the following areas
(1)
1. Any proposed project which is within one mile of the
municipal boundaries of the City of Boynton Beach.
2. Any area in the reserved annexation area of the City
of Boynton Beach.
3. Any area that reasonably would 'be expected to annex
into the City of Boynton Beach.
4. Any area where the proposed project may have an
impact upon municipal services including police, sewer, water,
utilities, drainage and fire within the City of Boynton Beach.
Section 2. That on all the proposed Land Development
changes enumerated in Section t, the County give the City Planning
Department an opportunity to make recommendations and express thei~
views prior to approval and the County carefully consider and not
a~bitrarily ignore any recommendation made 'by the City of Boynton
Beach upon these proposed projects.
Section 3. That the City Clerk is hereby instructed to
send a certified copy of the foregoing Resolution to the County
Planning and Zoning Director~ County Administrator and the Board
of County Commissioners at Palm Beach County.
Section 4. This Resolution shall take effect immediatel,
upon its passage.
