A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BOYNTON BHACH, FLORIDA., VACATING AND
ABANDONING A SPECIAL PURPOSE EASEMENT LOCATED
IN LOTS 34 AND THE WEST 6.00 FEET-OF LOT 35,
LAKE WORTH' i~kRtNER ~ILLAGE~ (LESS THE NORTH
35.00 FEET.AND THE SOUTH 2~5.00 FEET THEREOF),
AUTHORIZING THE MAYOR AND THE CITY CLERK TO
EXECUTE A DISCLAIMER TO SAID EASE~, AND
FOR OTHER PURPOSES.

it ms necessary that a SpeciD1 Purpose Easemen~
34 and the West 6.00 feet of Lot 35, Lake Worth
(less the North 35.00 feet and the South 25.00
feet thereof] be abandoned by the City in order to accommodate
the construction of the Lake Vista Townhouses Emst at the Inter-
section of Rider Road and N.E. 7th Street.
W~rIEREAS, Rycole Corp, which is the general partner of
the Howison Group shall be required to relocate the existing
water line at its own expense under the supervi.sion of the
Utility Department of the City of Boynton Beach and shall dedicat~
an easement to accommodate the water line.
WHEREAS, the public has no present or future use for
the easement abandoned hereby.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, that:
Section 1. The City of Boynton Beach, by and through
its City Council, does hereby vacate and abandon a Special Purpose
Easement, situate and being in the City of Boynton Beach, Palm
Beach County, Florida to wit:
The East 6.00 feet of Lot 34 and the West 6.00
feet of Lot 35, LAKE WORTH MARINER VILLAGE,
according to the plat therof, as recorded
in Plat Book 33, Pages 41 and 42t public
records, Palm Beach County, Florida.
LESS HOWEVERs, the North 35.00 feet and the
South 25.00 feet thereof.

Section 2. The Rycole. Corp., which is the general
partner of the Howison Group is hereby required to relocate the
existing water line at its ~own expense under the supervisio~ of
the Utility Department of the City of Boynton Beach and shall
dedicate an easement to accommodate the water line.
Section 3. The Mayor and City Clerk be and they are
hereby authorized and directed,to make, execute and deliver to
the Rycole Corp., which is the general partne~ of the Howison
Group a disclaimer to the above described easement,

Section 4. The City Clerk is hereby instructed to
furnish a certified copy of this~Resolution, together with the
original disclaimer to Terry Howison at the Rycole Corp., which
is the general partner of the Howison Group.
Section 5. This Resolution shall become effective
