80-ZRESOLUTION NO. 80~ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, DECLARING ACQUISITION OF LAND IN. FEE TITLE FOR THE CONSTRUCTION 0F LIFT STATIONSAND OF EASEMENTSFOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF SEWER FORCE MAIN AND WATER LINES, TO BE A PUBLIC NECESSITY; AUTHORIZING THE EMPLOYMENT OF APPRAISERS, AND AUTHORI.ZING THE FILIN~ OF EMINENT DOMAIN PROCEEDINGS. WHEREAS, the City Engineer has recommended the acquisition of certain lands in fee title for the construction of sanitary sewer lift stations, and WHEREAS, the specific land needed for said acquisition of fee title is described on Exhibit "A" attached hereto, and WHEREAS, the city Engineer has further recommended the acquisition of perpetual easements over lands which allow the city to construct, operate and maintain water main lines and force main lines for sewage purposes under and through the prop- erty, and WHEREAS, described in porated herein, and the specific land needed for said easements is Exhibit "B" attached hereto and by reference incor- WHEREAS, funds are available for the above-described acquisitions~'~ Wt{EREAS, this Council finds that the construction of said sanitary sewer lift stations and the construction and maintenance of the sewer force main lines on the lands described in Exhibits "A" and "B" attached hereto are necessary and essential Florida, and are a public necessity, and the same to the interest of Boynton Beach, WHERF~AS, this Council finds that the previously mentioned acquisition of the rights more particularly enumerated above in those lands described in Exhibits "A" and public necessity and in the best interest Florida, and NOW, City of Boynton Beach, Florida, "B" are also for the of Boynton Beach, THEREFOP~E, be it resolved by the city Council of the that: ~nd to see that judgment. 1. This Council adopts and ratifies those matters set forth .n the foregoing recitals. 2. The City Attorney is authorized sad directed to employ rea estate appraisers for the purposes of securing appraisals of the value of the property described in Exhibits "A" and "B" for the purpose of acquiring the aforementioned needed legal interest in ~aid properties. 3. The City Attorney is hereby authorized and directed to tek zhe necessary steps for Boynton Beach, Florida, to acquire in its )wn name by donation, purchase or eminent domain proceedings the Lnterest heretofore mentioned in the property described in Exhibits 'A" and "B" and to have prepared in the name of Boynton Beach all )epers, pleadings, and other instruments required ~Qr that purpose, all eminent domain%p~o~e~d~gs~e>prosecut~d~o~ 4.
