A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH, FLORIDA, REQUESTING PERMISSION
FROM THE BOARD OF COUNTY COMMISSIONERS PURSUANT
TO FLORIDA STATUTES 171.062 TO REZONE LAND TO
BE ANNEXED TO THE CITY OF BOYNTON BEACH, FROM
THE COUNTY'S ZONING CLASSIFICATION RM (MEDIUM
DENSITY) TO THE CITY'S ZONING CLASSIFICATION R-2
(SINGLE-AND TWO-FAMILY DWELLING DISTRICT)
WHEREAS, the City of Boynton Beach,
for annexation from HUGH F. CULVERHOUSE,

Road No. S-804 as same is recorded in
Road Plat Book No. 2, at Page 217 through
220; Public Records of Palm Beach County,
Florida, and Tracts 8 and 25 LESS the Westerly
250 feet (as measured along the South line
of said State Road S-804) of the Northerly
700 feet (as measured along the Westerly
line of said Trace 8 and 25) of that portion
of said Tracts lying Southerly of the South
Right-of-Way Line of State Road Noo S-804;
and LESS the West 25.0 feet of said portion
of Tract 25, ~l~ Tracts 26 and 27; all said
Tracts being a portion of Palm Beach Farms Com-
pany Plat No. 8, recorded in Plat Book 52 at
Page 73, Public Records of Palm Beach County,
Florida. Containing 17.7 acres, more or less.
WHEREAS, the City Council at the May 1, 1979 regular meet-

of the City Planner, feels that the proper zoning for this parcel
of land would be the City's Zoning Classification R-2 (single-
and two-family dwelling district) as defined in Section 5(f) of
the Zoning Regulations of the City of Boynton Beack~ Florida, with
a planned density, as represented in the said owner's application
for annexation, of 5.12 dwelling units per acre.
WHEREAS, Chapter 171.062 of Florida Statutes, requires that
when a municipality plans to annex property at a zoning classi-
fication which would permit a different density than that which is
currently in effect under County's regulations, that the municipality
must request and receive permission from the Board of County Com-
missioners for such a change;
NOW THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF BOYNTON BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council hereby requests permission
from the Board of County Commissioners of Palm Beach County to rezone
when annexed, the property described above, from County Zoning Dis-
trict P~f (Medium Density) to Boynton Beach Zoning District R-2
(Single-and two-family dwelling district).
Section 2. That a certified copy of this Resolution be
sent to the Board of County Commissioners of Palm Beach County,
and the County Director of Planning,
the County Administrator,
Zoning and Building.
