A RESOLUTION OF TIlE CITY COUNCIL OF THE
CITY 0FBOYNTON BEACH, FLORIDA, REQUESTING
THAT STATE 0F~ ~O~IDA TRANSFER OWNERsMIP
OF CERTAtN[sb~PLUS RIGHT-OF-WAY ON INTERSTATE
HIGHWAY NUMBER95 WITHIN THE CITY OF BOYNTON
BEACH, FLORIDA, TO THE SAID CITY FOR USE IN
CONJb~CTION WITM T~ SAID CITY'S EXISTING
FRESH WATER FACILITIES.
WHEREAS, the State of.Florida currently owns and is
holding for the benefit of the people of the State of Florida,
surplus right-of-way .on Interstate Highway Number 95 (1-95),
bounded on the north by the Woolbright Road overpass, the
east by 1-95, the south by the intersection of the 1-95 and
Seaboard Railroad right-of-way and the west by the Seaboard
Coastline Railroad; and
WZ4EREAS, the City of Boynton Beach. Florida, presently
owns and is developing, a water well-field just west of that
portion of the Seaboard Coastline Railroad that is directly
adjacent to the above-described surplus right-of-way; and
WHEREAS, said surplus right-of-way would be extremely
useful and beneficial to the City's water service by providing
an additional well-field as well as serving as an aquifer
recharge area for the City's existing fresh water wells, and
such use of this land would provide additional protection
to the City's water supply from contaminants owing to
residential and industrial pollutant seepage; and
WHEREAS, the City of Boynton Beach, if granted title to
said surplus right-of-way, would put the said property to
the uses hereinbefore described and would take all steps
necessary to insure that the said property would serve the
above described purposes;
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the surplus right-of-way, described

surplus right-of-way to the City of Boynton Beach, and that the
necessary communication between State and City Officials begin
as soon as possible in furtherance of thes~ends.
Section 3. The City of Boynton Beach hereby representsto
the State of Florida that, upon the City's obtaining title to
the said surplus right-of-way, the City will use the said
property for an additional fresh water well-field and aquifer
recharge area in conjunction with the City's adjacent e~×isting
well-field.
Section 4. That a certified copy of this Resolution
be forwarded to Mr. W. A. Maier, District Right of Way
Administrator, State of Florida Department of Transportation.
