AN ORDINANCE OF THE CITY COMMISSION OF
THE CiTY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 2. ADMINISTRATION,
SECTION 2-18 TO PROVIDE FOR AN INCREASE
IN THE RETURNED CHECK CHARGE IN
COMPLIANCE WITH FLORIDA STATUTE 166.251;
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFiCATiON AND AN EFFECTIVE DATE.
WHEREAS, Florida Statute 166.251 has been amended to
allow the governing body of a municipality to adopt a service
fee of $20.00 or 5 percent of the face amount of the check,
draft, or order, whichever is greater, for the collection of
a dishonoroed check, draft, or other order for the payment of
money to a municipal official or agency; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: That Chapter 2. Administration, Section 2-18
shall be amended by adding the words and figures in underlined
type and by deleting the words and figures in struck-through
type, as follows:
Sec. 2-18. Payment of moneys to city;
overdraft service fee.
There is hereby established a service fee of

($20.00) or five (5) percent of the face
amount...
Section 2: Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 3: Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid~ such decision shall not
affect the remainder of this Ordinance.
Section 4: This Ordinance shall become effective
immediately upon its final passage.
