A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BOYNTON BEACH, FLORIDA, REQUESTING PER~4ISSION
FROM ~
.HE BOARD OF COUNTY CO~MISSIONERS, PURSUANT
TO FLORIDA STATUTES 171.062, TO REZONE LAND TO BE
ANNEXED TO THE CITY OF BOYNTON BEACH FROM THE
COUNTY ZONING CLASSIFICATION AG (AGRICULTURAL
DISTRICT) TO THE CITY'S ZONING CLASSIFICATION
PLANNED UNIT DEVELOPMENT WITH LAND USE INTENSITY
OF 3.9.
WHEREAS the City of Boynton Beach~ Florida has received a
request for annexation from SU~IT ASSOCIATES LIMITED the owner
of the following proposed described property~
The Northeast quarter (NE 1/4) of the North-
west quarter (~5~ 1/4) of the Northeast quarter
(NE 1/4) of Section 1, Township 46 South,
Range 42 East, less and except the north 40
feet thereof;
WHEREAS~ the City Council at its regular meeting on
August 15~ 1978 considered this annexation reguest and upon the
ecommenaat~ons of its Planning and Zoning Board~ feels tha%
proper zonmng for this parcel of land would be the City's Zoning
(from County Zoning Classification AG (Agricultural District) to
the City's zoning classification ulanned unit development with
Land Use Intensity of 3.9~) and
WHEREAS Chapter 171.062 Florida ~atutes, requires
that when a Municipality desires to annex property at a zonin~
classification, which would permit higher density than is cur~
rently in effect under County regulations~ that the Mnnicipality
request and receive permission from the Board of County Commis-
szoners for such a change.
NOW, THEREFORE~ BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH~ FLORIDA:
Section 1: That the City Council hereby requests per-
mission from the Board of County Commissioners of Palm Beach
County to rezone, when anne×ed, the property described herein
above from AG (Agricultural District) which will result in an
increase in the density allowed in such land %o 4.64 units per acre
Section 2: That a certified copy of this resolution is
being sent to each member of the Hoard of County Commissioners~
the County Administrator and the Director of Planning~ Zoning and
Building.
