78-DD RESOLUTION NO. 78-~D YK-IP2itE~ S, it is deemed in the best interest of the City of of Boynton Beach, Florida that said City enter into a non-financial agreement with Palm Beach County for the purpose of participating in the Comprehensive Employment and Training Act of 1973. NOW, THEREFORE, BE IT RESOLVED BY THE CITY 2OUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section I: That the Mayor and City Clerk of the City of Boynton Beach, Florida :)be and the same are hereby authorized to enter into, on behalf of said City, and execute non-financial agreement with Palm Beach County, Florida, Dated May 9, 1978. Seal) NON-FINANCIAL AGRE~qENT THIS AGREEMENT made this by and between: day of , I978 PALM BEACH COUNTY, FLORIDA, a political subdivision of the State of Florida, hereinafter referred to as the "Prime S " ponsor , Community Action Council, here- inafter referred to as "Subgrantee". and City of Boynton Beach hereinafter referred to as the "Participating Agency" WtTNESSETH : WHEREAS, the Prime Sponsor is participating in the Comprehensive Employment and Training Act of 1973; hereinafter, referred to a~ "CETA"; and WHEREAS, the Prime Sponsor is required to administer programs und~ Title III within the limitations established pursuant to the YOuth Employment and Training Program of the Youth Employment and Training A~t of 1973; and, WHEREAS, the Subgran~ee and Participating Agency desire to coordi- nate and operate a "Work Experience" program; and, .WHEREAS, this Non-Financial Agreement shall become effective by both parties and shall be completed in light of the purpose of said Agreement by the 30th dayof September, 1978. NOW, THEREFORE, in consideration of the mutual benefits and consi-I derations hereinafter set forth, the parties hereto covenant and agree as follows: The Subgrantee agrees to: 1o Provide an eligible and qualified participant[s) 2. In cooperation with the'Participating Agency, develop a Work Experience Training Plan to suit the individual needs of the participant{s). The Training Plan(s) will become a part of this agreemenT. Provide counseling and support to the participant while rolled in Work Experience at the Participating Agency. Pay the participant{s) an hourly wage equal to the pre- vailing minimum wage in a prompt and timely manner. Provide Workmen's Compensation coverage for each partici- pant° Assist the Participating Agency with problems relating to the participant or his participation in the program at Participating Agency. B. The Participating Agency agrees to: 1. Provide the participant(s) employment in a settisg similar to that of a regular employee of the Participating Agency. 2. Supervise the participant(s) to insure the aquisition of appropriate work habits, behaviors, and skills in accord- ance with the participant's individual Training Plan. 3. Perform necessary program paperwQrk functions on a timely basis. ?hese will include reportin§ hours worked and monthly progress reports oN the participants progress. 4. Maintain contact with the Subgr~ntee's Laision Person. 5. Participating Agency encouraged to develop potential subsidized job placements. The Participating Agen'cy shall provide ~/orkiog conditions that meet all health and safety regulations, wage and hour regulations, and appli- cable provisions of the Child Labor Laws. In no case shall project parti- cipants be employed under this Agreement more than forty (40) hours per weeK. The Participating.Ag6ncy agrees and adheres to compliance'with the Youth Employment and Demonstration Projects Act of 1977 (YEDPA) and with the Hazardous_O~cupations Orders issued pursuant to the Fair Labor Standards Act and set forth at 29CFR 570.50 et seq. with respect to employment of youths under 18 years of age and the Child Labor Standards of 29 CF~ 570.31 et seq. with respect to employment of youths aged 14 and 15.
