78-BRESOLUTION NO. 78-6 A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, APPOINTING BURTON M. MICHAELS, ESQ., OF TALLAHASSEE, FLORIDA, AS SPECIAL ASSISTANT CITY ATTORNEY TO REPRE- SENT THE CITY IN THE FLORIDA LEGISLATURE ON THE CITY'S CLAIMS BILL, HOUSE BILL 138, AND/OR ON ANY OTHER PRO- POSED LEGISLATION RELATING TO THE S~BJECT MATTER THEREIN. WHEREAS, at the Special City Council Meeting of November 23, 1977, the City Council voted to hire a lobbyist in Tallahassee to represent the City before the Florida Legislature on its Claims Bill (House Bill 138) which provides for the reimburse- ment of funds representing the outstanding debt due on the City's existing wastewater treatment plant which is to be replaced by a new regional sewage treatment plant; and WHEREAS, the City Attorney was instructed to make the necessary arrangements to secure such representation in Tallahassee; and WHEREAS, pursuant thereto the City Attorney did make such arrangements for Such representation by contacting BURTON Mo MICHAELS~ ESQo~ of Tallahassee, Florida, who has agreed to repre- sent the City of Boynton Beach as aforesaid as Special Assistant City Attorney at the rate of compensation outlined in the Minutes of said Sppcial City Council Meeting of November 23, 1977; and WHEREAS, at said Special City Council Meeting of November 23, 1977, the City Council indicated that every effort should be made to salvage and to keep in operation the City's existing wastewater treatment plant notwithstanding the completion of a new regiona1 sewage treatment plant; NOW, THEREFORE~ BE IT RESOL~fED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACh, FLORIDA: S~d~io~l: That BURTON M. MICHAELS, ESQ., of Tallahassee, Florida, is hereby appointed as Special Assistant City Attorney to represent the City of Boynton on the City's Claims Bill, House proposed or pending Beach in the Florida Legislature Bill 138, and/or on any other legislation relating to the subject matter therein, and for such professional services his compensation shall be at the rate of seventy-five ($75.00) dollars per hour, and in the event that said House Bill 138 and/or any other legislation passed by the Florida Legislature relating to the subject matter therein should become law during this appoint- ment, then the said BURTON M. MICHAELS shall receive additional compensation of five (5%) percent of any amounts recovered or saved on behalf of the City of Boynton Beach as a result of the passage of such legislation. That said BURTON M. MICHAELS shall be entitled to such compensation for any services rendered subsequent to December 23, 1977. Section.,2: That this appointment may be terminated at any time on ten (10) days' written notice by either the City Council or by said BURTON M. MICHAELS, and in such event the said BURTON M. MICHAELS shall receive, when due, any unpaid compensation provided for in Section 1 for professional services which he rendered during this appointment. Section 3: That said BURTON M. MICHAELS is hereby authorized and directed to advocate and to seek the passage of any additional or alternative legislative proposals, or amendments to said House Bill 138, which would direct the Florida Department of Environ- mental Regulation and/or any other appropriate governmental agency to employ and to utilize all reasonable means to retain and to continue in operation the City's existing wastewater treatment plant. Section 4: That by Motion of the City Council duly passed at a public meeting, and with the concurrence of both the City Attorney and the said BURTON M. MICHAELS, additional authority of the said BURTON M. MICHAELS to act on behalf of the City of Boynton Beach which is not provided for herein, may be authorized without the necessity of any further Resolution of the City Council.
