A RESOLUTION OF THE CITY'OF BOYNTON BEACH
TO THE FLORIDA'CONSTITUTION REVISION
COMMISSION PROpOSInG. AN AMENDMENT TO
ARTICLE VIIi, SECTION 1 [h), OF THE
CONSTITHTION OF TP~ESTATE OF FLORIDA.
WHEREAS, Article VIII, Section 1 (h), of the Constituti~
of the State of Florida is in need of clarification in order to
eliminate ambiguity and uncertainty, and to give effect to the
intent expressed therein without the necessity of costly litigati~
among units of local government: now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH, FLORIDA:
Sec%ion 1: That the Florida Constitution Revision
Commission is urged to consider a proposed amendment to Article
VIII, Section l(h), of the Constitution of the State of Florida,
by which section now reads:
SECTION 1. COUNTIES. --
(h) TAXES; LIMITATION. Property situate within
munzcipalities shall not be subject to taxation for services
rendered by the county exclusively for the benefit of the pro-
perty or residents in unincorporated areas.
be amended to read:
SECTION 1. COUNTIES. --
(h) TAXES; LIMITATION. Property situate within
municipalities shall be subject to taxation for services rendered
by the county only to the extent the services rendered by the
~ounty benefit the property or residents of the municipalities,
as provided by general or special law.
Section 2: That upon the adoption of this resolution,
the City Clerk shall cause one copy to be mailed to each member
of the Florida Constitution Revision Commission, and shall also
cause one copy to be mailed to each municipal governing body in
Palm Beach County, the Palm Beach County Commission, and the
Palm Beach County Legislative Delegation.
Section 3: That this resolution shall take effect
immediately upon adoption.
PASSED AND ADOPTED this ~ ~ay of December, 1977.
