AN ORDINANCE BY THE CITY COb~ISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, REPEALING IN
ITS ENTIRETY ORDINANCE NO. 90-39; REPEALING
THE FOLLOWING SECTION OF CHAPTER 5 -
BUILDINGS, HOUSING AND CONSTRUCTION
REGULATIONS, ARTICLE I IN GENERAL~ SECTION 5-4
PERMIT FEES, IN THE CODE OF ORDINANCES, CITY
OF BOYNTON BEACH, FLORIDA; SETTING FORTH A NEW
UNIFIED PERMIT FEE SCHEDULE APPLICABLE TO
BUILDING, ELECTRICAL, PLUMBING, GAS,
MECHANICAL, SITE WORK, IMPROVEMENT AND OTHER
MISCELLANEOUS PERMITS TO BE SET FORTH AS A NEW
SECTION 5-4 PERMIT FEES; PROVIDING FOR
CONFLICTS, SEVERABILITY, CODIFICATION, AND AN
EFFECTIVE DATE.
WHEREAS, Section 166.201, Florida Statutes authorizes by
general law or by user charges or fees set by ordinance, an
amount of money necessary for the conduct of municipal
government, and
WHEREAS, Section 553.79, Florida Statutes provides for the
collection of reasonable fees for the issuance of permits, and
WHEREAS, Section 103.7 of the Standard Building Code
provides references to the collection of applicable permit fees,
based on the adoption of a fee schedule by the governing body,
and
WHEREAS, the need to simplify the existing permit fee
schedule has made it necessary to repeal Ordinance 90-39 in its
entirety, and to replace it with a new ordinance to properly
designate the appropriate section of the existing City Code to
set forth the appropriate permit fee, and
WHEREAS, the new City of Boynton Beach fee schedule will
simplify the permitting process, while at the same time minimize
confusion to the users.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. That Ordinance No. 90-39, which was duly
adopted by the City Commission on September 18, 1990, is hereby
repealed in its entirety.
Section 2. That chapter 5 - Buildings, Housing and
Construction Regulations, of the Code of Ordinances, City of
Boynton Beach, Florida, is hereby amended by repealing Article
I, Section 5-4 Permit Fees.
Section 3. There is hereby established a new Section 5-
4 Permit Fees of the Code of Ordinances, City of Boynton Beach,
Florida, which shall set forth a uniform comprehensive permit
fee schedule for building, electrical, plumbing, gas,
mechanical, site development, landscaping and other
miscellaneous permits. Said Section shall read as follows:
Section 5-4. PERMIT FEES
Prescribed fees. A permit shall not be issued until the
minimum fee of $35.00 for the first $3,000.00 or less total
valuation, plus $15.00 for each additional $1,000.00 of value
over $3,000.00 or portion thereof, has been paid. The permit
fee shall be based on the valuation of the proposed construction
of all items specified and detailed on the plans and/or listed
on the permit application. An amendment to a permit shall not
be issued until the additional fee, if any, due to an increase
in the estimated cost of the building, electrical, plumbing,
gas, mechanical, landscaping or site development, has been paid.
Section 4. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 5. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or word be
declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the remainder of this ordinance.
