AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING SECTION liE., APPENDIX A -
ZONING, BY AMENDING SETBACK REQUIREMENTS
FOR SWIMMING POOLS; PROVIDING FOR
CONFLICTS, SEVERABILITY, CODIFICATION AND
AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida has previous approved a minor modification to
Section ll.E of Appendix A - Zoning regarding swimming pool
setbacks; and
WHEREAS, the City Commission of the City of Boynton
Beach, Florida deems it to be in the best interests of the
citizens and residents of the City to modify the setback
requirements for swimming pools;
NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA~ THAT:
Section 1.
That Section liE. of Appendix A - Zoning
shall be amended by adding the words and figures in underlined
type and by deleting the words and figures in struck-through
type, as follows:
Section I1. Supplemental regulations.
SWIMMING POOLS.* Swirmr~ing pools shall be
located, designed, operated, and
maintained in accordance with the city
swix~ing pool ordinance and shall be
subject to the approval of the building
department. No swimming pool shall be
constructed closer than eight (8) feet
from any property line and no swimming
pool shall be built in front of the
building line. On corner lots, =~_~.~

comply with the corner lot setback
requirements of the applicable zonin~
district. Location of above ground pools
shall comply with building setback
requirements.
Section 2.
That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 3.
Should any section or provision of this
ordinance or portion hereof~ any paragraph, sentence or word
be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this
ordinance.
Section 4.
Authority is hereby granted to codify said
ordinance.
Section 5.
This ordinance shall become effective
immediately upon passage.
