O93-24 ORDINANCE NO. O93-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 18, PENSIONS AND RETIREMENT TO DELINEATE THE RESPONSIBILITIES OF THE PENSION ADMINISTRATOR IN LIEU OF THAT ACTION NOW UNDERTAKEN BY THE CITY CLERK, PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS, the City has entered into an Agreement for Pension Administration with an individual not employed by the City; and WHEREAS, Chapter 18 contains numerous references to duties and responsibilities regarding pension administration now performed by the City Clerk but covered under the City's Agreement for professional administration services; and WHEREAS, the City Commission desires to clarify the duties and responsibilities of the Pension Administrator and of the City Clerk. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Section 2. Chapter 18. Article I, Section 18-9 is amended to provide: 1. Except as otherwise provided herein all administrative duties associated with the maintenance of the pension accounts created by this Chapter including the preparation of records and reports, shall be performed by the Pension Administrator hired from time to time by the City. 2. Nothing herein shall diminish or alter the responsibility of the City Clerk to act as custodian of the official minutes of the pension boards. 3. The Pension Administrator shall act as secretary to all pension boards established by this Chapter and shall 1 provide the original minutes of said meetings to the City Clerk. Section 4. If any clause, section or other part of this Ordinance shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be considered as eliminated and in no way effecting the validity of the other provisions of this Ordinance. Section 5. That all Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith, be and the same are repealed to the extent of such conflict. Section 6. That this Ordinance shall take effect immediately upon adoption. PASSED ON FIRST READING this ~ day of July, 1993. PASSED AND ADOPTED ON SECOND READING this ~ day of 1993.
