AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORID~,~AMENDING
APPENDIX A - ZONING, SECTION
DEFINITIONS
OF TERMS, BY AMENDING THE /DEFINITION-- OF
ADULT ENTERTAINMENT ESTABLIS~ENT TO CONFORM
PALM BEACH/COUNTY ADULT
WITH
THE
ENTERTAINMENT CODE; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATI~NAND AN EFFECTIVE
DATE.
WHEREAS, Palm Beach County has adopted a comprehensive
Ordinance regulating adult entertainment; and
WHEREAS, the Palm Beth County Ordinance is effective
within the municipal bou~aries of the City of Boynton Beach
provided the City of BoSton has not opted out of the ordinance
and is effective up to :he extent of conflict with the municipal
ordinance; and /
WHEREAS, the C:y of Boynton Beach has not opted out of the
Palm Beach County/Adult Entertainment Ordinance, nor has the
City adopted a/comprehensive municipal adult entertainment
ordinance; and/
WHEREAS, :he City Commission has determined that it is in
the best int~ests of the citizens of the City of Boynton Beach
that all re~erences to adult entertainment establishments in the
City Code~e.amended/_ to conform with the Palm Beach County Adult
Entertai~ent Code to achieve maximum enforceability of the Palm
Beach C~unty Adult Entertainment Ordinance within the
municipal
boundaries of the City of Boynton Beach;
OW, THEREFORE, BE IT ORDAINED BY THE CiTY COMMISSION OF
THE/CITY OF BOYNTON BEACH, FLORIDA:

figures in underlined type and by deleting the words and numbers
in struck-through type, as follows:

Section 1. Definition of terms.
GENERAL DEFINITIONS...
ADULT ENTERTAINMENT ESTABLISHMENT. A business or

Section 2. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 3. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or word be
declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the remainder of this ordinance.
